| Abstract | ||||
| إن إعمال الحاجة في الأحکام أصبح من المشتبهات التي لا يعلمها کثير من الناس ، أضف إلى ذلک أن أکثر القضايا الفقهية المعاصرة سواءً تلک التي وقع البت فيها من طرف المجامع أو تلک التي لا تزال منشورة أمامها ترجع إلى إشکالية تقدير الحاجة وتقدير الحکم الذي ينشأ عنها : هل تلحق بالضرورة فتعطي حکمها أو لا تلحق بها ؟ سواءً کانت قضايا طبية تتعلق بعلاج العقم مثلاً أو الإجهاض ، أو قضايا اقتصادية تتعلق بالعقود الجديدة من إيجار ينتهي بالتمليک أو تأمين بأنواعه ، أو أحکام الشرکات والأسهم وعقود التوريد والشروط الجزائية الحافزة على الوفاء بمقتضى العقد . مما يعني أن تحديد علاقة الحاجة بالضرورة أصبح مفتاحاً لأقفال معضلة في المستجدات الطبية.
