Abstract | ||||
تناول هذا البحث الموسوم ب"المصطلح الأصولي عند الباقلاني الحكم الشرعي -أنموذجًا-"، والذي من أبرز أهدافه: إبراز منهجية الباقلاني -V- في التعامل مع المصطلح الأصولي، وبيان أثره -V- في تأسيس المصطلح الأصولي، وتطوره. وقد سلكت في هذا البحث المنهج الاستقرائي التحليلي، بتتبع المصطلحات الأصولية في الحكم الشرعي، ودراستها وبيان دور الباقلاني -V- في المصطلح الأصولي من حيث المنهجية، والتأسيس والتطوير. ومن أبرز النتائج: أن الباقلاني -V- أول من ذكر الحد الذي يذكره المناطقة، ويعتبر مؤسسًا لبعض المصطلحات الأصولية؛ كالمندوب، والحرام، والأداء، والإعادة، والقضاء، كما كان له دور في تطوير المصطلح؛ كالواجب، والمكروه، والمباح، والحسن، والقبيح، ويستشهد بالقرآن الكريم، والسنة النبوية، كما أنه يذكر ما تشترك فيه المصطلحات الأصولية، ثم يذكر الفروق بينها، ولا يُغفل جانب محترزات التعريف للمصطلح الأصولي؛ ليخرج غيره من المصطلحات المقاربة له. ومن أهم التوصيات: دراسة المصطلحات الأصولية عند الباقلاني -V-في غير الحكم الشرعي، وإبراز اختياراته وآرائه الأصولية. This research entitled "The Fundamentalist Term according to Al-Baqlani” dealt with the Sharia ruling as a model. One of the most prominent objectives of this research is to highlight the methodology of Al-Baqlani - May God have mercy on him - in dealing with the fundamentalist term, and explaining its impact on the establishment of the fundamentalist term, and its development. In this study, I adopted the inductive and analytical approach, by tracking the fundamentalist terms in the Sharia ruling, studying them and explaining the role of Al-Baqlani in the fundamentalist terminology in terms of methodology, establishment and development. Among the most prominent results: that Al-Baqlani was the first to mention the Genus-Differentia (definition) mentioned by the logists, and he is considered the founder of some fundamentalist terminologies, such as the recommendable, unlawful, Al-Adaa (performance of the religious duty in its legally prescribed time), Al-Eada (repetition of the worship once again in the time), and Al-Qadaa (doing all temporary worship outside its prescribed time). Al-Baqlani also has a role in the development of the fundamentalist term, such as duty, repugnant, permissible, good, and ugly. And when explaining some fundamentalist terms, he cites the Holy Qur'an and the Sunnah of the Prophet, and he also mentions what fundamentalist terms share, then mentions the differences between them. He does not neglect the aspect of the precautionary definition of the fundamentalist term; to remove other terms that look like it. | ||||
