Abstract | ||||
فإن تماسك المجتمع ووحدته مقصد مهم من مقاصد التشريع، حثت دعت إليه النصوص الشرعية المختلفة، ولما كانت الفتوى لها مكانتها ومنزلتها فى الدين ، فإن للفتوى المؤسسية دوراً مهما في تحقيق هذا المقصد، ومنع الاختلاف والتفرق وذلك سواء بالنسبة للمفتين أو المستفتن، وذلك لكثرة النوازل والمستجدات التى تحتاج إلى مزيد من الدراسة والتخصص، للوصول إلى الحكم الشرعي الصحيح، وهو أمر لا يتحقق بالنسبة للفتاوى الفردية، والتى قد تخطئ أو تتحدد أو تتضارب، فتؤدى إلى حدوث الاضطراب والاختلاف، وهو ما يدعو إلى ضرورة دعم المؤسسات الإفتائية ماديا ومعنويا، وتنظيم أمر الفتوى ومنع غير المتخصصين من التصدى لها . The cohesion and unity of society is one of the important purposes of legislation, which was urged by various Islamic texts. Since the fatwa has its place and status in religion, the institutional fatwa has an important role in achieving this purpose, and in preventing disagreement and disunity, whether for muftis or muftis, because of the many new developments that require further study and specialization, in order to reach correct Islamic rulings, which cannot be achieved for individual fatwas, and which may err, be determined or conflict, and lead to chaos and difference. This is why it is necessary to support Fatwa institutions financially and morally, and to regulate the issue of fatwas and prevent non-specialists from confronting it . | ||||
