| Abstract | ||||
| من أهم خصائص القاعدة القانونية أنْ توضع عامة ومجردة، لا تخاطب شخصاً بذاته، ولا تستهدف واقعة بعينها، ولهذا كانت بحاجة إلى فهمها عند تطبيقها في الواقع العملي، من حيث مضمونها، ومن حيث نوع الوقائع التي تشملها بحكمها، ويتم ذلك من خلال تفسيرها، وتكييف الوقائع لتحقيق مناط حكمها العام في صورها، فالتفسير والتكييف قوام الحكم القضائي السليم، ويعدان من الأَسباب الأساسية في اختلاف الأحكام القضائية، والاجتهادات الفقهية، صحة، وبطلاناً، قصوراً، وكمالاً، نظراً لتفاوت الأفهام والقرائح، والتكوين العلمي، والاستعداد الفطري للأَفراد، لذا تبدو عملية التكييف القانوني للتحقق من مناطات الأَحكام في الوقائع غاية في الأهمية لتطبيق النص على الوقائع بصورة سليمة، وهذا ما فطن إليه علماء الفقه وأصوله قديما وطبقوه على النصوص الشرعية، بصورة دقيقة وواضحة، يمكن الاعتماد عليها في تكييف وتطبيق النصوص القانونية المعاصرة، وقد تم الاعتماد في إعداد هذا البحث على المنهج الوصفي، والمنهج التحليلي، وكذلك المنهج الاستقرائي الذي يقوم على الملاحظة العامة للجزئيات بغرض الوصول إلى وضع أحكام كلية عامة، بالإضافة إلى المنهج الاستنباطي الذي يبدأ بالحقائق الكلية ثم ينتقل إلى الحقائق الجزئية، مع مراعاة قواعد البحث في العلوم الفقهية والقانونية. One of the most important characteristics of the legal rule is to be general and abstract, without addressing a specific person or a specific incident in particular. Therefore, it needs to be understood when applied to reality, in terms of its content, and in terms of the type of cases that it covers. This is done through the interpretation of the legal rule and the adaptation of the cases to provide adequate justifications for each case. Interpretation and adaptation are the foundation of sound judicial judgment. They are considered among the main reasons for the difference in judicial rulings and jurisprudential rulings based on reasoning, in terms of validity and invalidity, inadequacy, and perfection. This is due to the differences in understandings, perceptions, scientific formation, and the innate readiness of individuals. Therefore, the process of legal adaptation to verify the justifications provided in the various cases seems very important to apply the text to the facts properly. This research relies on the descriptive approach, the analytical approach, as well as the inductive approach, which is based on the general observation of the particulars in order to reach general rules, in addition to the deductive approach that begins with the general facts and then moves to the partial facts. | ||||
