| الوصية بالتصرُّف بجسد الميت (دراسة فقهية مقارنة) مشاعل بنت سعد بن عويض الحربي طالبة دكتوراة، قسم الدراسات الإسلامية، كلية الشريعة والدراسات الإسلامية، جامعة القصيم، المملكة العربية السعودية. البريد الإلكتروني: aood-233@hotmail.com ملخص البحث: في الوقت التي انتشرت عمليات زراعة الأعضاء، بل وجعلت من هذه العمليات بابًا من أبواب إنقاذ الأنفس البشرية، فكان من اللازم من البحث في أحكام الوصية بالتصرُّف بجسد الميت من خلال التساؤلات الآتية: ما حكم الشرع بالتبرُّع بالأعضاء من الميت؟ ما حكم الشرع بالوصية بالتبرُّع بالأعضاء؟ ما حكم الوصية بالجسد كاملًا لغرض البحث العلمي والتشريح؟ وذلك من خلال دراسة الموضوع دراسة فقهية مقارنة، مع إعطاء تصوُّر واضح عن مفهوم الوصية والتصرُّف، وتحليل المسائل المتعلقة بالوصية بالتصرُّف بجسد الميت تحليلًا دقيقًا، والحكم عليها من خلال قرارات مجاميع الفقه والهيئات الشرعية والآراء الفردية من الفقهاء المعاصرين، ودراسة أدلة كل رأي؛ بهدف التوصّل إلى الرأي المختار منها. الكلمات المفتاحية: الوصية، التصرُّف، الوصية بالتبرُّع بالأعضاء، الوصية بالتبرُّع بالجثة لغرض التعليم. The Bequest to Dispose of the Body of the Dead A Comparative Jurisprudential Study Mashael bint Saad bin Awaid Al-Harbi PhD student, Department of Islamic Studies,Faculty of Sharia and Islamic Studies, Qassim University, E-mail: aood-233@hotmail.com Abstract: At a time when organ transplantation operations became widespread, and even these operations have become of the causes that lead to the ruins of human souls, it was necessary to research the provisions of the bequest to dispose of the dead body through the following questions: What is the Islamic ruling on organ donation from the dead? What is the Islamic ruling on the bequest to donate organs? What is the ruling on bequeathing the whole body for the purpose of scientific research and anatomy? This is done by studying the subject in a comparative jurisprudential study, giving a clear perception of the concept of bequest and disposition, analyzing carefully the issues related to the bequest to dispose of the body of the dead and judging them through the decisions of the jurisprudence groups, the Islamic organizations and the individual opinions of contemporary jurists and studying the evidence of each opinion with the purpose of reaching the chosen opinion.
