| Abstract | ||||
| من حين لآخر يثار الجدل حول التراث الفقهي، من حيث: ضرورة تجديده، وصولًا إلى إمكانية تجاوزه، والنظر إليه على أنه عائق أمام اللحاق بركْب العصر، بعضها يصدر من أعداء الإسلام كالمستشرقين، وبعضها من أبنائه الذين تتلمذوا على أيديهم، كلها يتفق على أنه لم يعد صالحًا لزماننا، وأنه قد آن الأوان للتخلص منه أو بتعبير أخف تهذيبه وتنقيته، مع الحط من قدره والتشكيك في صلاحيته، وتسليط الضوء عليه بشكل مجتزأ ومبتسر ومشوَّه، دون وضعها في إطارها الصحيح، وزمانها، وطبيعتها البشرية، وسياقها، ومسؤولية واضعها الفردية عنها...ويهدف البحث إلى إبراز أهمية التراث الفقهي، وأسباب الطعن فيه، وأهدافه، ووسائله، وأدواته، ثم الرد على أهم الشُبه الواردة عليه، وخلُصت من خلال البحث إلى أن المتخصص لا يحتاج إلى بذل جهد كبير ليرى ضعف هذه الشُبه، وتعمد بعضها تزييف الحقائق، أو اللجوء لمنطق غير صحيح للوصول إلى نتائج تهدف في النهاية إلى رسم صورة مشوهة عن التراث وأهله، ولتحقيق الاستفادة من تراثنا المبعثر في أنحاء عديدة من دول العالم لابد أن يتحرك المتخصصون للدفاع عنه، والتوسع في تدريسه، والتوعية بخطر النيل منه، وعرضه على أبنائه بأحدث الوسائل المعاصرة، في الوقت الذي نرى من يهاجمونه يعرضون ما لديهم بشتى وسائل التواصل الحديثة. Controversies about the jurisprudential heritage, which range from the necessity of renewing it to viewing it as an obstacle to catching up with the progress of modern age are raised by the enemies of Islam, such as the Orientalists, and their disciples who are nominally Muslim. The research aims to highlight the importance of the jurisprudential heritage, the reasons for challenging it, its goals, means, and tools, and then respond to the most important fallacies contained therein. I concluded through the research that the specialist does not need to make a great effort to see the weakness of these fallacies, and that some of them deliberately falsify the facts, or resort to incorrect logic to reach results that ultimately aim to paint a distorted picture of the heritage and its people. To benefit from our heritage, which is scattered in many parts of the world, specialists must move to defend it, expand its teaching, raise awareness of the danger of undermining it, and present it to its children using the latest means. | ||||
