| Abstract | ||||
| تهدف هذه الدراسة إلى بيان الحكم الشرعي للشريحة الدماغية الجديدة التي أنتجتها شركة "نيورالينك" مع بيان حكم ضمان إتلاف مال الغير الناتج عن الخلل في هذه الشريحة، وقد تناولت دراستي ماهية الذكاء الاصطناعي من حيث نشأته وتعريفه، وضوابط استخدامه في الشريعة الإسلامية والمعايير الأخلاقية الضابطة لتقنياته، ثم ذكرت ماهية الشريحة الدماغية وإيجابياتها وسلبياتها، ثم تطرقت إلى شروط زراعة الشريحة الدماغية في الدماغ، وحكم هذه الزراعة إذا كانت لهدف ضروري أو هدف تحسيني، ثم ختمت بضمان خلل الشريحة الدماغية، فذكرت شروط الضرر المستحق للضمان، وضمان إتلاف مال الغير نتيجة الخلل في الشريحة الدماغية من حيث مسؤولية الجهة المصنعة أو المركبة لهذه الشريحة، أو مسؤولية من لديه الشريحة الدماغية، وقد توصلت إلى أنه لابد من مراعاة الشروط الشرعية عند زراعة الشريحة الدماغية، ومع مراعاة الشروط الشرعية يجوز زراعتها إذا كان الهدف منها ضروري، ولا يجوز على المختار إذا كان الهدف من زراعتها تحسيني، وأنه إذا توافرت شروط الضمان وثبت تقصير الجهة المصنعة أو المركبة للشريحة فإنها تضمن إتلاف مال الغير نتيجة الخلل في الشريحة، وإذا لم يثبت التقصير فإنها لا تضمن، أما بالنسبة لمن لديه شريحة دماغية فإنه يكون له حكم المكرَه إكراهًا ملجئًا، فيضمن إتلافه لمال غيره على المختار. This study aims to explain the Sharia ruling on the new brain chip produced by Neuralink, along with explaining the ruling on ensuring the destruction of others’ property resulting from a defect in this chip. This study deals with the nature of artificial intelligence in terms of its origin, definition, the precepts of its use in Islamic Sharia, and the ethical standards governing its techniques. The study also introduces the brain chip, its pros and cons, and touches on the conditions for implanting a brain chip into the brain. Then, the research concludes by discussing the guarantees based on the defects of the brain chip. The study tackles the conditions for the damages due to the guarantee, and the guarantee for the destruction of someone else’s property as a result of a defect in the brain chip, whether this defect is the responsibility of the manufacturer, the installer of the chip, or the person with the brain chip. Among the results of the study is that the Sharia conditions must be taken into account when implanting a brain chip, as it may be permissible in some cases and not permissible in others. | ||||
