| Abstract | ||||
| يهدف البحث إلى توضيح المفهوم الخاص بالنفقة وما هي أنواع النفقات، وأحكامها في كلٍّ من الفقه الإسلامي وقانون الأحوال الشخصية الكويتي، وتعود مشكلة البحث إلى كثرة قضايا النفقات المقدمة للمحاكم الكويتية، فقد سدد صندوق تأمين الأسرة خلال عام 2022م نفقات تقدر بأكثر من مليون دينار كويتي، حيث بلغ إجمالي النفقة الزوجية التي قدمها الصندوق (50520) دينارا، بينما بلغت نفقة الأولاد (576540) دينارا، غير أن الفقه الإسلامي وقانون الأحوال الشخصية لم يوردا أي حكم يخصّ ذوي الهمم بحكم خاص في النفقات، وقد توصل الباحث لعدد من النتائج والتوصيات، فكان من أبرز النتائج: أنّ الفقه الإسلامي حدد أنواع النفقات بثلاث جهات وهي نفقة الزوجة، ونفقة الأقارب، ونفقة المملوك، بينما حددها قانون الأحوال الشخصية بجهتين فقط وهي نفقة الزوجة ونفقة الأقارب، ولم يفرق الفقهاء وقانون الأحوال الشخصية في نفقة الزوجة بين ذوي الهمم وغيرهم، بل جعلوا النفقة على الرجال، سواء من ذوي الهمم أو من غيرهم، وكان الاعتبار فقط بتوافر الشروط في الزوجة لاستحقاق النفقة وجاء من أهم التوصيات تخصيص لجنة تابعة للمحكمة لدراسة أحوال ذوي الهمم، في حال رُفعت قضية نفقة ضدهم، وبيان هذه الأحوال للمحكمة، وتقديم المعونة لهم في حال عجزهم عن دفع ما عليهم من مستحقات. The research aims to clarify the concept of alimony, the types of alimony, and the related rulings in both Islamic jurisprudence and the Kuwaiti Domestic Relations Law. The problem of the research is due to the large number of alimony cases submitted to the Kuwaiti courts during the year 2022 AD. The Family Insurance Fund paid more than one million Kuwaiti dinars for alimony cases. However, both Islamic jurisprudence and the Domestic Relations Law do not have any special rulings on alimony pertaining to disabled people. Among the most notable results are: Islamic jurisprudence specifies the types of alimony in three aspects, which are the wife’s maintenance, the expenses of the relatives, and the expenses of the owned, while the Domestic Relations Law specifies them in only two aspects, which are the wife’s alimony and the expenses of the relatives. The jurists and the Domestic Relations Law do not differentiate in the case of wife’s alimony between disables people and others. Rather, they place the expenses on men whether they are disabled or not. What matters is whether the wife meets the conditions to be entitled to alimony. | ||||
