| يعد موضوع ، التعسف في استعمال من المواضيع التي تتسم بالصبغة القانونية والقضائية معا، وتعيشه مختلف المحاكم بالمملكة عند نهاية المراحل الطويلة للنزاعات أمام القضاء، من خلاله يحصل المتضرر على اكتساب حقه، ووضع حد لتعنت وعناد المتعسف. و تأطيرا لموضوع هده الدراسة سنحاول بيان وتوضيح موقف القضاء المغربي من نظرية التعسف في استعمال الحق، مقتصرين في ذلك على موقف القضاء المغربي من نظرية التعسف في التبرعات عقد الهبة "نموذجا" The issue of abus in use on of the topics that have a legal and judical nature together and is experienced by the various courts in the kingdom at the end of the long stages of conflicts before the judiciary though which the victim obtains his right and puts an end to the arbitrary intransigence and stubbornness and the subject the use of the right is limited in this to the position of the morroccan judiciary on the theory of abus in the original real right We are limited in the position of the moroocane judiciary on the theory of arbitrariness in donations the gift contract | ||||
