| Abstract | ||||
| التسبيب للأحكام القضائية من أخصّ الموضوعات المتعلقة بالمرافعات الشرعية، فالتسبيب القضائي ضمانة للقاضي في استقلال حكمه وصرفه عن النزعات الشخصية وتغليبٌ لها، وهو بيان للوقائع المؤثرة في إصدار القاضي لحكمه، وتطبيقٌ للمستند الشرعي أو النظامي على الواقع. فتسبيب الحكم والحالةُ هذه من أعظم الضمانات المشروعة للقضاة، فهو مظهرٌ من مظاهر استقلالهم وقيامهم بما خوّلوا به من بحث وإمعان لبيان الحكم وإظهار العدل فيما يفصلونه من القضايا والنزاعات، فالتسبيب له دورٌ فعّال في تمحيص رأي القاضي وحسنِ دراسته للقضيّة المعروضة عليه، لعلمه بضرورة تقديم الحجّة القضائية لما تبناه من رأي، فلا يكون رأيه سطحياً أو منفعلاً. ومن جهة أخرى فإن للمتنازعين حقاً في معرفة سبب الحكم -لهم أو عليهم- لما فيه من تطييب الخواطر والرضا بشرع الله -تبارك وتعالى- ولما فيه من إتاحة الفرصة لهم كذلك في حقَّ الاستئناف أو النقض للحكم عند تحقق شروطه. وفي هذا البحث يتطرق الباحث إلى مشروعية التسبيب للأحكام القضائية، وحكمهُ في الشريعة الإسلامية، والنظام القضائي بالمملكة العربية السعودية، مع بيان مقاصد التسبيب والمناهج العاصرة المتبعة فيه. Reasoning for judicial rulings is one of the most specific topics related to Sharia pleadings. Judicial reasoning is a guarantee for the judge in the independence of his ruling and that he distances himself from and gives priority to personal conflicts. It is a statement of the facts affecting the judge’s issuance of his ruling, and an application of the Sharia or regulatory document to reality. Reasoning for a ruling and this situation is one of the greatest legitimate guarantees for judges, as it is a manifestation of their independence and their doing what they are authorized to do in terms of research and careful consideration in order to explain the ruling and show justice in the cases and disputes they decide. Reasoning has an effective role in scrutinizing the judge’s opinion and his good study of the case before him, because of his knowledge of the necessity of presenting the argument. Judicial opinion based on the opinion he adopted, his opinion should not be superficial or emotional. On the other hand, the disputants have the right to know the reason for the ruling - for them or against them - because it purifies people’s minds and is satisfied with the law of God - Blessed and Most High - and because it also gives them the opportunity to have the right to appeal or veto the ruling when its conditions are met. In this research, the researcher addresses the legitimacy of causation for judicial rulings, its ruling in Islamic law, and the judicial system in the Kingdom of Saudi Arabia, while explaining the purposes of causation and the contemporary approaches followed in it. | ||||
