| Abstract | ||||
| يُبيّن البحث علاقة نظرية ابراهام ماسلو (التدرج في الحاجات الإنسانية) ، بالسياسة الشرعية وسنّ الأنظمة ، ويُبين سبق الشريعة في ضبط مصالح الناس والرقي بمستويات الإبداع خاصةً في مجال الأنظمة. وأنّه بإمكان السياسة الشرعية تلافي الانتقادات لنظرية ابراهام ماسلو خاصةَ صعوبة قياس الإشباع لكل حاجة ، من خلال فهم مقاصد الشريعة الضرورية والحاجيّة والتحسينية ، والتي ترجع إلى حفظ خمسة أشياء: الدين - العقل - النفس - النسل – المال ، ومن خلال ضبط الحاجات حسب الأعراف التي تناسب البشر حتى يتحقق الإبداع وتُحَّل المشكلات بيسر وسهولة ، وتَقِّل الجرائم في المجتمع . The research shows the relationship of Abraham Maslow's theory (hierarchy of needs) to Sharia policy and the enactment of regulations. It demonstrates the precedence of Sharia law in controlling people's interests and raising levels of creativity, especially in the field of regulations. In addition, the Sharia law policy can avoid criticism of Abraham Maslow’s theory, especially the difficulty of measuring the satisfaction of every need, by understanding the essential and improving purposes of Sharia law, which are due to preserving five things: religion - sanity - soul - lineage - money. Throughout controlling these needs according to appropriate tradition, creativity will be achieved, problems will solved easily, and crimes in society will be reduced. | ||||
