| Abstract | ||||
| یسبق مرحلة التعاقد النهائي، مرحلة تمهیدیة تؤدي على وجهٍ محققٍ، أو غیر محققٍ إلى المرحلة النهائیة، وأبرز الصور لهذه المرحلة التمهیدیة الوعد بالتعاقد، الذي يُنظر إليه في الفقه الإسلامي على أن الوفاء به مِن الصفات الحسنة التي يجب على كل مسلمٍ أن يتحلى بها، وإن كان الخلاف في مدى هذا الطلب هل هو واجب، أو مستحب؟ ولكن يُنظر إليه في القانون الوضعي على أنه وسيلة تستهدف الوصول إلى العقد النهائي، فهو عقد يهدف الوصول لعقدٍ آخر مختلف في ذاته، وبالتالي إذا تصرف الواعد بمحل التعاقد، فهل مِن حق الموعود له أن يحل محل الغير في الشيء محل الوعد، أم لا؟ أرى مِن خلال البحث محل الدراسة: أنه إذا تصرف الواعد بمحل التعاقد، كان مِن حق الموعود له الحلول محل الغير في الشيء محل الوعد، وخاصةً إذا كان الوعد مقرونًا بسببٍ، ودخل الموعود له في السبب؛ لأن ذلك يدل على العزم على الوفاء، ويُرتب الكلفة للموعود له، وفي حالة عدم الوفاء مِن الواعد، فإن ذلك يُرتب ضررًا للموعود له، وهو منهي عنه؛ لحديث رسول الله ــــ صلى الله عليه وسلم: "لا ضرر ولا ضرار"، فيلزم الواعد بالتعويض، وخير تعويضٍ هو إلزامه بالوفاء، ويكون مِن حق الموعود له التمسك بالتزام الواعد. The final contracting stage is preceded by a preliminary stage that leads, whether achieved or not, to the final stage. The most prominent form of this preliminary stage is the promise to contract, which is viewed in Islamic jurisprudence as fulfilling it as one of the good qualities that every Muslim must possess, even if The disagreement was over the extent of this request: is it obligatory or desirable? But it is viewed in positive law as a means aimed at reaching the final contract. It is a contract aimed at reaching another contract that is different in itself. Therefore, if the promisor acts on the subject of the contract, does the promisee have the right to replace another person in the thing that is the subject of the promise, or not? From the research under study, I see that if the promisor disposes of the subject of the contract, the promisee has the right to take the place of others in the thing that is the subject of the promise, especially if the promise is linked to a reason, and the promisee is involved in the reason; Because this indicates the determination to fulfill, and arranges the cost for the promisee, and in the event of non-fulfillment by the promisee, this causes harm to the promisee, and it is forbidden; According to the hadith of the Messenger of God - may God bless him and grant him peace: “There is no harm or harm,” the promisee is obligated to make compensation, and the best compensation is obliging him to fulfill, and the promised person has the right to adhere to the promiser’s obligation. | ||||
