| Abstract | ||||
| يهدف هذا البحث إلى بيان حقيقة عقد تجميد النطف والبويضات المخصبة، وتكييفه الفقهي، وحكمه، وبيان الالتزامات المترتبة على طرفيه. وتكمن أهمية هذا الموضوع في أنه يربط بين الفقه الاسلامي ومستجدات العصر، وأنه يتناول مدى خطورة الدور الذي تلعبه مراكز حفظ النطف والبويضات المخصبة؛ حيث يجب عليها أن تلتزم بعدة التزامات مقابل التزامات أخرى تقع على عاتق المستفيد. وقد توصلت الدراسة إلى أن عقد تجميد النطف والبويضات المخصبة يكيف على أنه عقد جديد له طبيعته الخاصة، وقد ترجح لدي القول بجواز هذا العقد بضوابط وشروط، وأنه يرتب التزامات على كلا الطرفين، فيلتزم مركز الحفظ بالإعلام، وحفظ النطف والبويضات محل العقد، وتعد يده على هذه العينات يد أمانة، كما يجب عليه أن يلتزم بالسرية، كما يلتزم المستفيد بتسليم العينات لمركز الحفظ، وبدفع الأجرة. وتوصي الدراسة بأنه يجب الالتزام بالضوابط الشرعية اللازمة لهذه العملية، وتشديد الرقابة على عمل هذه المراكز؛ خوفا من اختلاط العينات. This research aims to explain the truth about the contract to freeze sperm and fertilized eggs, its jurisprudential adaptation, its ruling, and to explain the obligations resulting from its parties. The importance of this topic lies in the fact that it links Islamic jurisprudence with the developments of the times, and that it addresses the seriousness of the role played by centers for preserving sperm and fertilized eggs. It must adhere to several obligations in exchange for other obligations that fall on the beneficiary. The study concluded that the contract to freeze sperm and fertilized eggs is considered to be a new contract with its own nature, and I think it is more likely to say that this contract is permissible subject to controls and conditions, and that it imposes obligations on both parties, so the conservation center is obligated to inform and preserve the sperm and eggs subject to the contract, and it is in control of the contract. These samples are in trust, and he must adhere to confidentiality. The beneficiary is also obligated to deliver the samples to the preservation center and pay the fee. The study recommends that the necessary legal controls for this process must be adhered to, and oversight of the work of these centers must be tightened. For fear of mixing samples. | ||||
