| Abstract | ||||
| يهدف البحث إلى إلقاء الضوء على استحالة تنفيذ الالتزام المُعلق على شرط قبل تحققه وبيان أحكامه في القانون المدني والفقه الإسلامي، وقد اعتمدت في بحثي على المنهج التحليلي التأصيلي المقارن، حيث يُبين القواعد العامة التي تحكم الموضوع وفروعه المختلفة، وتوصلت في بحثي لعدد من النتائج من أهمها أن استحالة التنفيذ هي وضع استثنائي عن هدف المشرع المتمثل في ضمان استقرار المعاملات والالتزامات التعاقدية الذي لا يكون إلا بتنفيذ المتعاقد لالتزامه، فهي تمثل رخصة تعفي المتعاقد المدين من تنفيذ التزامه، وينقضي بها هذا الالتزام، وانحلال العقد أو انفساخه لاستحالة تنفيذه يتم من تلقاء نفسه أي بقوة القانون دون حاجة لتمسك أحد المتعاقدين به أو صدور حكم من القضاء بذلك، وأن حق الدائن المعلق على شرط واقف حق وليس مجرد أمل، وأن هذا الحق ينتقل من صاحبه إلى غيره بالأسباب العادية لانتقال الحق كالميراث أو الحوالة وبغير ذلك من التصرفات كالبيع والهبة والوصية، بجانب أن استحالة تنفيذ العقد في مدة خيار الشرط الفاسخ قبل تحققه، تعتبر قيدًا يمنع من تطبيق الأثر الرجعي للفسخ، ومقتضى القاعدة العامة للأثر الرجعي لفسخ شرط الخيار أن يكون الضمان على البائع، لأن فسخ خيار الشرط يترتب عليه إعادة المتعاقدين إلى حالتهما قبل التعاقد، أي بأثر رجعي . This research aims to shed light on the impossibility of implementing the obligation attached to a condition before its fulfillment and to clarify its provisions in the civil law and Islamic jurisprudence. The most important of them is that the impossibility of implementation is an exceptional situation from the legislator’s goal of ensuring the stability of contractual transactions and obligations, which is only for the contractor to fulfill his obligation, as it represents a license that exempts the debtor from the implementation of his obligation, and this contract is terminated, and the contract is dissolved or abrogated. The case of its implementation is carried out on its own, i.e. by force of law without the need for a contractor to adhere to it or a ruling by the judiciary to that effect. That is from behaviors such as selling, gift, and will, besides the impossibility of executing the contract in the term of the abrogated condition before its fulfillment, it is considered a restriction that prevents the application of the retroactive effect of the annulment, and according to the general rule of the retroactive effect of the annulment of the option condition that the guarantee be on the seller, because the cancellation of the condition of the condition entails the return The contractors to their condition before contracting D, i.e. retroactively | ||||
