| Abstract | ||||
| تعد مهنة الطب من أهم المهن الإنسانية ، حيث يتعين فيها بذل الحرص من جانب الطبيب بهدف سلامة جسم الانسان ، والمحافظة علي أرواح الناس أثناء ممارسته لواجباته ، حيث أن مهنة الطب تفرض عليه واجباً قانونياً واخلاقياً ، يتمثل في بذل جهود صادقة لعلاج مرضاه . ولقد اتسعت دائرة العلوم الطبية وتجددت اليوم كما تعددت الأدوات والوسائل التي يستخدمها الطبيب في العلاج، وهذا ما جعل المريض يعتقد في كثير من الأحيان فشل الطبيب في العلاج أو الجراحة ، وبالتالي الخلط بين حق المريض في الرعاية الطبية وبين حقه في سلامة صحته وضمان الشفاء، ففي كثيرمن الأحيان يخفق الطبيب في العلاج أو الجراحة وهنا لا يتردد المريض في نسبة الخطأ أو التقصير إلي هذا الطبيب أو ذاك الجراح . وقد تحدث أخطاء من قبل المرفق الطبي العام وهو بصدد الممارسة لهذه الاعمال فتلحق ضرراً بالمرضي مما يوجب تعويضهم بالمرضي مما يوجب تعويضهم، وغالباً ما يطلق القضاء الإداري علي هذه الأخطاء وصف الخطأ في تنظيم وتسيير المرافق . The medical profession is one of the most important humanitarian professions, in which care must be exercised on the part of the doctor with the aim of protecting the human body and preserving people’s lives while exercising his duties, as the medical profession imposes on him a legal and moral duty, which is to make sincere efforts to treat his patients. The circle of medical sciences has expanded and been renewed today, and the tools and methods used by the doctor in treatment have multiplied, and this is what often makes the patient believe that the doctor has failed in treatment or surgery, thus confusing the patient’s right to medical care with his right to the safety of his health and ensuring recovery. Many times the doctor fails in treatment or surgery, and here the patient does not hesitate to attribute the error or negligence to this doctor or that surgeon. Errors may occur on the part of the general medical facility while it is in the process of performing these tasks, causing harm to patients, which necessitates compensating them. The administrative judiciary often describes these errors as an error in the organization and management of the facilities. | ||||
