Abstract
المؤرخ هو ضمير الأمة، وهو من يسجل ماضي الشعوب، ويرسم رؤى المستقبل، ومن ثمّ فقد بات الحديث عن ركن الخطأ في المسؤولية التقصيرية للمؤرخ الناشئة عن  توثيق الحقيقة التاريخية أمرًا مهمًا يعكس مدى مصداقية ما كتبه المؤرخون، فالمؤرخ ملتزم بأن يكون صادقًا وأمنيًا، وأن يقول الحقيقة من من دون تزييف أو تحريف، وبالنظر إلى عدم وجود تعريف قانوني للمؤرخ في غالبية الدول، فقد تبنينا في هذه الدراسة مفهومًا واسعًا للمؤرخ بأنه: كل من يمارس مهنة الكتابة ذات الطابع التاريخي.
وقد تجسدت إشكالية هذا البحث في التساؤل عن صور الخطأ في مجال المسؤولية التقصيرية للمؤرخ وحالات الإعفاء منها.
وللإجابة عن هذا السؤال قسمنا البحث إلى مبحثين: تناولنا في أولهما صور خطأ المؤرخ، وخصصنا ثانيهما للحديث عن حالات انتفاء خطأ المؤرخ .
وقد خلصنا في نهاية هذا البحث إلى العديد من النتائج من أهمها: أن المؤرخ لديه الحرية الكاملة في تحليل الحقائق التاريخية وفقًا لبعض القيود التشريعية والقضائية؛ وبناء على ذلك يجب على المحاكم مراعاة خصوصية عمل المؤرخ، وفائدته الاجتماعية.
 
Abstract:
The historian is the conscience of the nation, which records the past of peoples, and draws visions of the future, and then it has become talking about the corner of error in the tort responsibility of the historian arising from documenting the historical truth is important that reflects the credibility of what historians wrote, the historian is committed to be honest and security, and to tell the truth without falsification or distortion, and given the lack of a legal definition of the historian in most countries, we have adopted in this study a broad concept of the historian that:  Anyone who practices the profession of writing of a historical nature.
The problem of this research was embodied in the question of the forms of error in the field of tort liability of the historian and the cases of exemption from it.
To answer this question, we divided the research into two sections: we dealt with the first pictures of the historian's error, and we devoted the second to talk about the absence of the historian's error. At the end of this research, we have concluded many conclusions, the most important of which are: that the historian has complete freedom to analyze historical facts in accordance with some legislative and judicial restrictions; and accordingly, the courts must take into account the specificity of the historian's work, and his social benefit.
