Abstract | ||||
Humanity's common cultural heritage possesses strict legal protection at the national and international levels. Legal texts have emerged to protect it since the beginning of the contemporary organization of armed conflicts, but this organization have focused on the traditional forms of armed conflict between and among States. With the emergence of new non-State actors, the need to update these texts and international conventions constituting international humanitarian law has arisen. Modern armed terrorist groups pose a threat to human cultural heritage because they either wish to destroy it because they believe it must be destroyed according to their ideology, They are either illegally trafficked to finance their terrorist activities and have practiced unprecedented violations against the world's cultural heritage in the areas they occupied in the 1990s to the last decade, This called on the international community to act to develop a legal framework and multiple efforts and initiatives to stop these unprecedented violations of this heritage. International efforts to protect the common cultural heritage of humanity during the recent war with terrorism have diversified from legal efforts for military and police movements, even international judicial and criminal convictions, but the basic conventions of international humanitarian law still need to be amended to allow for further international protectionist and judicial moves against perpetrators of such violations on non-State actors' human cultural heritage. | ||||
