| Abstract | ||||
| عمليّة غسيل الدّماغ وسيلة تقنيّة تؤدي إلى تحوير الفكر أو السلوك ضدّ رغبة الإنسان أو إرادته، ولها أهداف ودوافع تخضع لها، كما تعتمد طريقة عمليّة غسيل الدّماغ في أغلب أساليبها على العنف، والقهر، والإقناع الجبريّ، والتهديد بالقتل، وغيره. ولعمليّة غسيل الدّماغ مجالات مختلفة، وأول استخدام لها كان في حالة الحرب، ومع الأسرى، ويُعدُّ الإكراه عمليّة ضغط من المكرِه على إنسان آخر مكرَه ظلمًا، وبوسيلة مرهبة، أو بتهديد أو إجبار على تصرّف ما يمتنع عنه المكرَه، وإذا تحققت صور وشروط وأركان الإكراه الأربعة في عمليّة غسيل الدّماغ فهو مُكرَه ينطبق عليه ما ينطبق على الإكراه من الثواب والعقاب. ويُعدُّ الإكراه من أكبر الكبائر إذا وقع تحت الظلم والعدوان، وعمليّة غسيل الدّماغ من هذا القبيل، وعقد النّكاح عبارة عن إيجاب وقبول، وله شروط شرعيّة تتضمن إباحة استمتاع الرجل من امرأة لم يمنع من نكاحهما مانع شرعي، وقد دلّت الأدلة على مشروعيّته، والراجح في الإكراه على عقد النّكاح عدم صحة نكاح المكرَه، وبناءً على ذلك عدم صحة نكاح المغسول دماغيًّا. The process of brainwashing is a technical method which leads to change the thought or behavior against a person’s desire or willingness. This process has different goals, motives,and the most important of which are criminal field, ideological, personal, and other goals. The method of the brainwashing process also depends in most of its methods on violence, oppression, coercive persuasion, death threats, etc. The brainwashing process has different fields, and its first use was in era of war with prisoners. There is also a difference between the brainwashing process and hypnosis process, which is subject to gentleness, compassion, and mercy in most of its cases, while the brainwashing process is subject to conquer and coercion in most of its cases. Coercion is considered a process of pressure from the coercer on another person who is unjustly coerced, and it has forms, conditions, and elements. If they are fulfilled in the process of brainwashing,so he is coerced, and it applies on him same which is applied to entirely coerced as a form of reward and punishment. The fundamental evidence has indicated the legitimacy of coercion, but it is considered one of the greatest sins if it occurs under injustice and aggression. And The contract is an offer of agreement and acceptance with Shari’a conditions, and the marriage contract includes the permissibility of a man having sexual intercourse with a woman without a Shari’a impediment preventing them from marrying. It has indicated Sharia evidence on the legality of the marriage contract, and what is most likely regarding coercion into a marriage contract is that the marriage of the coerced person is not valid, and based on that, the marriage of the brainwashed person is not valid. | ||||
