| Abstract | ||||
| هذه رسالة ماجستير بعنوان "أثر قواعد دفع التعارض على أحكام الحج دراسة فقهية مقارنة" للطالبة: ريم بنت محمد بن صالح الصقير. وقد احتوت هذه الرسالة على مقدمة وتمهيد بينت فيه قواعد دفع التعارض، وأقسامه، وأسبابه وشروطه، وفصلين، وخاتمة. ويحتوي الفصل الأول على ثلاثة مباحث، المبحث الأول في أثر دفع التعارض في المسائل المتعلقة في مواقيت الحج، وفيه مطلبان، والمبحث الثاني في أثر دفع التعارض في المسائل المتعلقة بشروط الحج، وفيه مطلب، والمبحث الثالث في أثر قواعد دفع التعارض في المسائل المتعلقة في محظورات الحج، وفيه سبعة مطالب. واحتوى الفصل الثاني على ثلاثة مباحث، المبحث الأول: في قواعد دفع التعارض في المسائل المتعلقة بأنساك الحج، وفيه مطلب، والمبحث الثاني في أثر دفع التعارض في المسائل المتعلقة بأركان الحج، وفيه أربعة مطالب، والمبحث الثالث في أثر دفع التعارض في المسائل المتعلقة بواجبات الحج، وفيه أربعة مطالب، ثم ذكرت الخاتمة وتشمل أهم النتائج والتوصيات، ثم اتبعتها بملحق تراجم العلماء، ثم الفهارس الفنية المتعارف عليها. وسعيت في هذا البحث إلى بيان الأدلة المتعارضة في أحكام الحج، وبيان مسالك الفقهاء في تلك الأدلة من خلال استعمال قواعد دفع التعارض، وبيان أثر قواعد دفع التعارض عليها، وخلاصة ما توصلت اليه في هذا البحث أن التعارض ظاهر نسبي في جميع المسائل، وأن العلماء سلكوا مسالك في دفعها إما بالجمع أو النسخ أو الترجيح، وقد تنوعت مسالكهم باختلاف الأدلة الواردة في المسألة. This is a master’s thesis entitled “The Impact of the Rules of Defending Conflict on Hajj Rulings, a Comparative Jurisprudential Study” by the student: Reem bint Muhammad bin Saleh Al-Suqair. This thesis contained an introduction and preface in which the rules for defending conflict were explained, its sections, causes and conditions, two chapters, and a conclusion. The first chapter contains three sections. The first section is on the effect of eliminating conflict in issues related to the timings of Hajj, and it contains two questions. The second section is on the effect of eliminating conflict in issues related to the conditions of Hajj, and it contains a request. The third section is on the effect of the rules of avoiding conflict in issues related to prohibitions. Hajj, which has seven requirements. The second chapter contained three topics. The first topic: on the rules of preventing conflict in matters related to the rituals of Hajj, and it contains a demand. The second topic is on the effect of preventing conflict in matters related to the pillars of Hajj, and it contains four demands. The third topic is on the effect of preventing conflict in matters related to the duties of Hajj. It contains four demands, then I mentioned the conclusion, which includes the most important results and recommendations, then I followed it with an appendix to the biographies of scholars, then the recognized technical indexes. In this research, I sought to explain the conflicting evidence in the rulings on Hajj, and to explain the approaches of the jurists in that evidence through the use of the rules of avoiding conflict, and to explain the effect of the rules of avoiding conflict on them. The conclusion of what I reached in this research is that the apparent contradiction is relative in all issues, and that the scholars have taken the same approach. There are ways to refute it, either by combining, abrogating, or preferring it. Their methods varied depending on the evidence contained in the issue. | ||||
