| Abstract | ||||
| لم تكن البشرية في حال بدائية مهيمنة حيوانية قاتمة خاضعة لقانون الغريزة فقط. ولكن العصور البدائية تشعبت في بعض مناحيها ان إنسانية الانسان خالدة حتى قبل التمدين والحضارة وخلق القوانين. فهناك العديد من صور العنف ضد المرأة كالعادات والموروثات السلبية التي تتجلي في تشويه الاعضاء التناسلية للمرأة أو ما يسمي ختان المرأة أو حرمان المرأة من الميراث، والى جانبها الظروف الاجتماعية والاقتصادية والدينية. وسوف نعرض في ظل هذه المعطيات لهذا التطور الحاصل بخصوص مواجهة هذه الجرائم الجسيمة ضد المرأة. من خلال التعرف على العنف ماهية وتحديداً، ونطاق الحماية الدولية التي تشمل المرأة في مواجهة هذا العنف. من خلال المؤسسات الدولية الرئيسية العالمية والإقليمية، ومن خلال المواثيق العالمية المختلفة. وتطور السياسة الجنائية في هذا الإطار وضوابط التشريع في مواجهة الظاهرة الاجرامية وهي ظاهرة العنف ضد المرأة منتهيا الى خاتمة تضمنت خلاصة البحث مشموله بعدد من النتائج وعدد من التوصيات. وتقديم البحث بثبت المراجع العلمية التي رجع إليها الباحث مبوبة ومرتبة بطريقة علمية وبمنهجية علمية. Absrtact: Humanity was not in a primitive, dominant state of dark animals, subject only to the law of instinct. But primitive ages branched out in some respects that the humanity of man was immortal even before urbanization, civilization and the creation of laws. There are many forms of violence against women, such as negative habits and legacies that are manifested in female genital mutilation, the so-called circumcision of women, or the deprivation of inheritance for women., along with social, economic and religious conditions. Considering these data, we will present this development in confronting these grave crimes against women. By identifying the nature and specificity of violence, and the scope of international protection that includes women in the face of such violence. Through the main global and regional international institutions, and through various global conventions. The development of criminal policy in this context and the controls of legislation in the face of the criminal phenomenon, which is the phenomenon of violence against women, ending with a conclusion that included the conclusion of the research included several results and a number of recommendations. And submit the research with the scientific references that the researcher referred to, classified and arranged in a scientific manner and with a scientific methodology. | ||||
