| الترجيحُ والردُّ روايةً ودرايةً عند فقهاء الحنفية أحمد محمد السيد المرسي العفيفي قسم الفقه العام، كلية الشريعة والقانون بطنطا ، جامعة الأزهر ، مصر. البريد الإلكتروني: m.roshdy77@azhar.edu.eg الملخـص: تناول هذا البحث منهجاً من مناهج الترجيح والرد التي اتبعها المتأخرون من الحنفية، والتي رجحوا بها بين الروايات في المذهب، أو ردوها، وهو منهج يعنى بعرض القول على الرواية والدراية، فإن كانت الرواية معتبرة في المذهب؛ لثبوتها عن القائل بها بسندٍ صحيحٍ كانت راجحةً روايةً، وإن ظهر الدليل الذي يرجح القول بعد النظر والتأمل من قبل المجتهد كان راجحاً درايةً، وهذا في جانب الترجيح بين الأقوال والروايات في المذهب، أما في جانب رد الرواية والقول: فإذا لم تظهر حجة القول ودليله وظهر دليل مُقابِله وقويت حجتُه، كان مردوداً من جهة الدراية، وإن كان مخالفاً للروايات الثابتة عن أئمة المذهب، كان مردوداً من جهة الرواية، ومن الأحكام ما جمع في ترجيحه بين الرواية والدراية، فكان في أعلى درجات الترجيح، ومنها ما كان راجحاً من جهة الدراية أو الرواية، وقد تناولت التأصيلَ لهذا المنهج من خلال التعريف بماهيته وبيان أسسه وضوابطه، وترتيب الروايات المرجحة في المذهب الحنفي روايةً ودرايةً، وعرض بعض التطبيقات الفقهية للترجيح والرد رواية ودراية. وقد اعتمدت في هذا البحث على المنهج الاستقرائي؛ حيث قمت باستقراء كتب المذهب الحنفي لاستخراج الفروع الفقهية لموضوع البحث من مصادرها المعتمدة، والمنهجِ التحليلي الذي يقوم على تحليل ما ورد عن أئمة المذهب من ترجيحات، بغية الوصول إلى القول المرجح أو المردود من جهة الرواية والدراية، والوصول إلى الأسس والضوابط التي بنى عليها الفقهاء هذا الترجيح أو الرد. وقد انتهى البحث: إلى أن رواية الأصول تُرجَّح على غيرها من الروايات، وقد يختلف الترجيح بين الأقوال بناء على الاختلاف في تحديد رواية الأصول، وأن فقهاء الحنفية قد يرجحون روايةً غير رواية الأصول إذا كان لها وجه في الدراية، ومن الممكن ترتيب الأقوال المرجحة رواية ودراية حسب قوة الترجيح على النحو التالي: المرتبة الأولى: الراجح من جهة الرواية ومن جهة الدراية، المرتبة الثانية: الراجح من جهة الدراية دون الرواية، المرتبة الثالثة: الراجح من جهة الرواية دون الدراية، كما سيأتي بيانه في محله من البحث. Email: drahmedafefy87@gmail.com Abstract: This research paper has dealt with the approach of preponderance and disapproval as followed by the late jurists of the Hanafi school. They have utilized this approach to give preponderance to narrations within their school of jurisprudence or disapprove them. This approach is concerned with exposing statements in terms of transmission and investigation. If the narration is identifiable by the school of jurisprudence for being proved after the one who narrated it according to a truthful chain of transmission, the narration then becomes preponderant. Moreover, the narration becomes preponderant by means of investigation when the evidence that gives preponderance to the statement appears after the diligent reviews and contemplates the narration, and this could be related to preponderance in between narrations and statements of the same school of jurisprudence. As for disapproving the statement and the narration, when the statement lacks proof or evidence, and counter evidence or proof comes to the ground, the statement would be disapproved by means of investigation but it disagrees with the consistent narrations of the Imams of the school of jurisprudence. Hence, it becomes disapproved with reference to transmission. Some provisions combine narration and investigation in their preponderance so that they become of the highest degree of preponderance. Other provisions become preponderant in terms of the narration or the investigation. This research paper has traced the origins of preponderance as an approach by defining its entity, stating its principles and rules, putting the preponderant narrations of the Hanafi school of jurisprudence in order in terms of their transmission and investigation. In addition, the paper has displayed some jurisprudential applications of preponderance, disapproval, transmission and investigation. The research has applied the inductive approach as the researcher has gone through the books of the Hanafi school of jurisprudence to explore the jurisprudential branches relevant to this topic from identifiable resources. It has also applied the analytical approach which relies on analyzing instances of preponderance that have been inherited after the Imams of the school to reach the preponderant or disapproved statement in terms of transmission and investigation as well as establishing the rules and principles upon which the jurists based such preponderance or disapproval. This research paper has concluded that the narration of the fundamentals is more preponderant than others. Moreover, preponderance varies in between statements because of the disagreement about specifying the narration of the fundamentals. Jurists of the Hanafi school may give preponderance to a specific narration rather than that of the fundamentals if it has an investigated aspect. It is also possible to arrange the preponderant and investigated statements according o their degree of preponderance as follows; the first degree is assigned to the preponderant and investigated transmission whereas the second is for the investigated only but the third for the solely preponderant transmission. | ||||
