| جهود علماء الأزهر في التأصيل الفقهي للمسائل الطبية شاكر حامد على حسن جبل قسم الفقه، كلية الدراسات الإسلامية والعربية، جامعة الأزهر، فرع بنى سويف، القاهرة، مصر. البريد الإلكتروني: shakerHamed.2277@azhar.edu.eg الملخـص: اعتمد الباحث على المنهج التحليلي، والاستدلالي، حيث اشتمل على جانب نظري تكلمت فيه عن معنى التأصيل الفقهي، والألفاظ ذات الصلة به كالمأخذ، والاختيار الفقهي، والتخريج الفقهي، والفرق بين الفتوى المؤصلة وغيرها، وأهمية التأصيل للفقيه والمفتي، فلا يلقى الحكم للمستفتى بلا دليل، وليس المراد في بحثنا حصر أدوات التأصيل الفقهي، وضوابطه، وإنما التنبيه على نماذج ترشد الطلاب إلى مزيد من البحوث في ها، وأما الجانب التطبيقي فتناولت فيه بعض المسائل الطبية لدى علماء الأزهر، وكيفي ة الاستدلال لها بالأدلة المختلفة من القرآن، أو السنة، أو القياس، أو القاعدة الأصولية، أو الفقهية، ووضع الشروط، والضوابط، واستخدام العلل. والاختيار الفقهي والتخريج، وسواء من الفتاوى أو الأبحاث التي نشروها. Efforts of Al- Azhar Scholars in the Jurisprudential Origination of Medical Issues By: Shaker Hamed Ali Hassan Jabal Department of Jurisprudence Faculty of Islamic and Arab Studies in Beni Suef Azhar University, Egypt. Email shakerHamed.2277@azhar.edu.eg Abstract This researcher has applied the analytical and deductive approaches. The theoretical framework handles the meaning of jurisprudential origination, related words such as defect, jurisprudential choice, jurisprudential authentication, the difference in between originated fatwa and other genres, the importance of origination for the jurist and the Mufti. Hence, the final provision is not given to the person seeking fatwas without evidence. The main objective of this research paper is not to determine the tools of jurisprudential origination and their regulations, but rather to draw attention to models that would guide students along further research within this field. As for the practical aspect, the paper has addressed some medical issues for Al-Azhar scholars, how to prove them relying on various clues from the Holy Qur’an, Sunnah, analogy, the fundamental or jurisprudential rules. Moreover, the paper tries to set conditions and terms, to give reasons, jurisprudential choice and authentication whether from fatwas or the published research. | ||||
