| Abstract | ||||
| يهدف البحث الى دراسة قضية الخلاف الفقهي بين المذهب الحنبلي وخاصة المسالة حكم وقوع الطلاق وقت بدعه التى خالف فيها الإمام ابن مفلح مذهبه الحنبلي ومن النتائج التي تواصلت اليها الدراسة أن الخلاف بين الإمام ابن مفلح ومذهبه الحنبلي هو الخلاف في فهم دلالات النصوص الشرعية ولايعني هذا الخلاف تعصبه لمذهبه ولكن هذا الخلاف يؤدى الي فائده جديده على حسب كل مسأله وهي تناسب مستجدات العصر الذي يتطور من جيل الي جيل وليس هذا تغير في الشريعة ولكن الاختلاف الذي يؤدي الي اختلاف أوجه الأستنباط. Abstract The research aims to study the issue of the jurisprudential disagreement between the Hanbali school of thought, especially the issue of the ruling on divorce at the time of its heresy in which Imam Ibn Muflih contradicted his Hanbali school of thought. Among the results that the study reached is that the dispute between Imam Ibn Muflih and his Hanbali school of thought is a disagreement in understanding the implications of the legal texts, and this disagreement does not mean fanaticism for his doctrine. But this disagreement leads to a new benefit | ||||
