المصطلح هو الوعاء الذي يحمل العلوم ويحافظ عليها، وهو يمثل اللغة الخاصة بكل علم، ولا تتجلّى العلوم إلا في مصطلحاتها وألفاظها، فقد حازت مصطلحات الفنون على شرف الاهتمام وشرف المكانة، لا سيّما المصطلحات الشرعية وما يلحق بها، إذ المحافظةُ عليها رمزٌ على قوَّة الأمة ووحدتها، ودليلٌ على الوعي والثبات.
وتتجلّى أهمية المصطلح في فنّ أصول الفقه؛ في كون المصطلح الأصولي هو المدخل الأساسي الآمن لفهم مسائل هذا العلم وإدراك مباحثه وضبط مفاهيمه ومضامينه، ومن ثَمَّ فهو وسيلة من وسائل تقويض الخلاف وتضييق مساحته، إذًا فمن مهمات طالب أصول الفقه معرفة مصطلحات هذا العلم؛ حتى يستطيع حل ما يعترضه من مشكلات ومعضلات أثناء دراسة هذا العلم، ولا تلتبس عليه الأمور وتتشابك، ويختلط الحابل بالنابل، ولا يستطيع أن يميز بين الحق والباطل، لذلك جاءت هذه الدراسة بكشف اللثام عن المصطلح الأصولي، وبيان خصائصه، وبيان المصطلحات الأصولية التي أورثت إشكالًا.
Abstract:
The terminology is the vessel that carries and preserves the sciences, and it represents the language specific to each science, and the sciences are only manifested in their terms and words, as the terms of the arts have gained the honor of interest and the honor of status, especially the legal terms and what is related to them, as preserving them is a symbol of the strength and unity of the nation, and evidence of awareness and steadfastness.
The importance of the terminology is evident in the art of the principles of jurisprudence; The terminology of the principles is the basic and secure entrance to understanding the issues of this science, comprehending its topics, and controlling its concepts and contents. Therefore, it is a means of undermining the disagreement and narrowing its scope. Therefore, it is one of the tasks of the student of the principles of jurisprudence to know the terminology of this science, so that he can solve the problems and dilemmas that he encounters while studying this science, and matters do not become confusing and intertwined for him, and the rope is mixed with the arrow, and he cannot distinguish between truth and falsehood.
Therefore, the current study came to uncover the terminology of the principles clarify its characteristics, and clarify the terms of the principles of jurisprudence that caused a problem. |
