Abstract | ||||
يهدف هذا البحث إلى بيان مفهوم التحول الرقمي وأهميته وأهدافه ومزاياه، ثم بيان المقصود من كارت الفلاح الذكي وأهدافه ومزاياه ومعوقاته، وشروط الحصول عليه وكيفية استخراجه، وحكم التصرف في الأسمدة والمستلزمات التي يتيحها الكارت الذكي مع بيان أقوال الفقهاء القدامى والعلماء المعاصرين فيما يتصل بذلك من مسائل مقرونة بالأدلة والمناقشات والترجيح، وقد سلكت في بحثي هذا المنهج الاستقرائي حيث تتبعت الجزئيات والصور المشابهة للنازلة موضوع البحث في كتب التراث الفقهي، كما اتبعت في هذه الدراسة المنهج الاستنباطي حيث حاول الباحث استنتاج الأحكام المتعلقة بكارت الفلاح الذكي من أصول الشرع ومقاصده وقواعده المستمدة من أصوله، وانتهى الباحث إلى عدة نتائج أهمها: أن التحول الرقمي يهدف إلى تحقيق التنمية المستدامة الشاملة في كافة القطاعات، ومن أهم أهداف كارت الفلاح الذكي الرقي بأسلوب الإدارة وإنشاء قاعدة بيانات حديثة لتسهيل وصول الدعم لمستحقيه، يعد كارت الفلاح الذكي نوعًا من أنواع الدعم السلعي الذي تحث عليه الشريعة وتشجعه، ويندرج تحت عقد الهبة، والراجح في التكييف الفقهي للجمعيات التعاونية الزراعية أنها تبرع، ولا يجوز بيع الأسمدة الكيماوية المدعمة كليًّا حتى لو تسلمها الفلاح وقبضها، أما إذا كان الدعم جزئيًّا فيصح البيع في غير المدعوم ويبطل في المدعوم، ولا يجوز للفلاح بيع الأسمدة المدعومة كليًّا عن طريق إعطاء الكارت الذكي للغير قبل قبض الأسمدة من الجمعية التعاونية الزراعية وحيازتها، أما إذا كان الدعم جزئيًّا فيبطل في المدعوم وكذلك لا يصح في ملكه بناء على الراجح من أقوال الفقهاء في بيع المبيع قبل قبضه. Abstract: This research aims to explain the concept of digital transformation, its importance, objectives and advantages, then explain the purpose of the smart farmer’s card, its objectives, advantages and obstacles, the conditions for obtaining it and how to apply to get it, and the ruling on disposing of fertilizers and supplies provided by the smart card, with a statement of the sayings of older jurists and contemporary scholars regarding related issues joined with evidence, discussions and preference. In my research, I followed the comparative descriptive approach through identifying the issues and points to be studied and describing them in an accurate manner that removes their confusion with other similar issues, and the inductive approach, as I traced the details and forms similar to the incident that is the subject of the research in the books of jurisprudential heritage. I also followed the deductive approach in this study, as I tried to deduce the rulings related to the smart farmer’s card from the origins of Sharia, its objectives and rules derived from its origins. The researcher concluded with several results, the most important of which are: the digital transformation aims to achieve comprehensive sustainable development in all sectors, and among the most important objectives of the smart farmer’s card is to improve the management style and create a modern database to facilitate the support for those who deserve it. The smart farmer’s card is a type of commodity support that Sharia urges and encourages, and it comes under the contract of gift, and the most likely in the jurisprudential adaptation of agricultural cooperatives is that it is a donation, and it is not permissible to sell fully subsidized chemical fertilizers even if the farmer receives and collects them. However, if the support is partial, the sale is valid for the unsubsidized and invalid for the subsidized. The farmer is not permitted to sell fully subsidized fertilizers by giving the smart card to others before collecting the fertilizers from the agricultural cooperative and possessing them. However, if the support is partial, it is invalid for the subsidized and is also invalid for his ownership according to the most preferable of the jurists’ sayings on selling the sold item before collecting it. If the quantity of fertilizers allocated to the farmer is loaded onto the smart card system and the quantity is not present in the warehouses of the agricultural cooperative, the presence of the quantity on the smart card system is not considered an actual receipt of it. It is also not permissible to take the farmer’s smart card and pay the price of the quantity of fertilizers available in the card balance even if the quantity is present in the cooperative. | ||||
