| Abstract | ||||
| يهدف البحث إلى بيان حكم تخدير الجاني قبل تنفيذ العقوبة عليه، وإيضاح أثر مقصد الإيلام في الإباحة أو المنع، وقد سلكت فيه المنهج الاستقرائي والاستنتاجي، وقسمته على مقدمة، ومبحثين، وخاتمة. جاء المبحث الأول موضحًا المراد بالتخدير في اللغة، وأن له أصلين: أحدهما يدل على الستر والظلمة، والآخر على البطء والإقامة، والمراد بالتخدير في الفقه وأنه يرد على معنيين: أحدهما المرأة المخدرة التي لا تخالط الرجال، والثاني ما يخدر العقل والحواس وهو المراد، والمراد به في الطب وهو قريب من المعنى الثاني في الفقه، وفي هذا المبحث أيضًا تعريف العقوبة وأنواعها. وأما المبحث الثاني ففيه دراسة حكم تخدير الجاني قبل تنفيذ العقوبة، فإذا كانت العقوبة حدًّا، فإما أن يكون قتلًا فلا يجوز التخدير إن كان القتل بالرجم؛ لاعتبار مقصد الإيلام، ويجوز في القتل بغير الرجم. وإما أن يكون الحد قطعًا ففيه خلاف والمختار جوازه؛ لتحقيق مبدأ الإحسان وحصول النكال متحقق، وإما أن يكون الحد جلدًا فلا يجوز التخدير؛ لأن الإيلام مقصود ومعتبر فيه. وإذا كانت العقوبة قصاصًا فمن أهل العلم من ذهب إلى عدم الجواز مطلقًا، ومنهم من ذهب إلى عدم الجواز إلا إن أذن صاحب الحق ورضي؛ لأن القصاص حقه، وله أن يسقطه كله بالعفو، فإسقاط بعضه -وهو الإيلام- من باب أولى. وإذا كانت العقوبة تعزيرًا فمرجعه إلى الحاكم إن كان التعزير قتلًا أو قطعًا، وأما الجلد فلا يتحقق معه إباحة التخدير؛ لاعتبار مقصد الإيلام فيه. وختمت البحث بأبرز النتائج، وأتبعته بفهرس للمراجع والمصادر، وآخر للموضوعات. The study aims to clarify the ruling on anesthetizing a perpetrator before executing the punishment on him and to elucidate the impact of the objective of causing pain in permitting or prohibiting it. I adopted the inductive and deductive methods, and divided the research into an introduction, two sections, and a conclusion The first section explains the meaning of anesthesia in the language, noting that it has two origins: one indicating covering and darkness, and the other indicating slowness and staying. It also covers the meaning of anesthesia in jurisprudence, which refers to two senses: the first being a secluded woman who does not mix with men, and the second referring to substances that numb the mind and senses, which is the intended meaning. It also includes its meaning in medicine, which is close to the second sense in jurisprudence. Additionally, this section defines punishment and its types The second section studies the ruling on anesthetizing the perpetrator before executing the punishment. If the punishment is a hudud (fixed punishment), and involves killing, anesthesia is not permissible if the killing is by stoning, due to the consideration of causing pain. However, it is permissible in other forms of execution If the hudud involves amputation, there is a difference of opinion, but the preferred view is its permissibility to achieve the principle of kindness while still ensuring deterrence. If the hudud involves flogging, anesthesia is not permissible as causing pain is intended and considered. If the punishment is qisas (retaliation), some scholars prohibit anesthesia entirely, while others permit it only with the consent of the right holder, as qisas is their right and they can waive it entirely by forgiving, so waiving part of it—causing pain—is even more permissible If the punishment is ta'zir (discretionary punishment), it is up to the judge if the ta'zir involves killing or amputation. However, flogging does not permit anesthesia due to the consideration of causing pain. The research concludes with the most significant findings, followed by a bibliography of references and sources, and a table of contents | ||||
