| Abstract | ||||
| إن علم أصول الفقه للشريعة كعلم النحو للسان العربي، به تستنبط الأحكام الشرعية، وبه تعرف درجات المصالح عند التزاحم، ودركات المفاسد عند التلاطم، كما يميز به صحيح الفتاوي من فاسدها. وقد قيض الله له رجالا أفذاذا أنفقوا فيه نفائس الأعمار على مرّ الأعصار؛ خدمة لدين الإسلام؛ وحرصا على فهم مدلول كتاب الله، وسنة نبيه محمدٍ-صلى الله عليه وسلم-فهما سليما، حتى وصلت النوبة إلى عصرنا الحاضر عصر التخصصات والجامعات، وعلى رأسها الجامعة الإسلامية بالمدينة المنورة، تلكم الجامعة التي أشرقت الأرضُ بنور مُخْرَجاتها، وطاب حِمل طلابها كما طاب معدن ترابها، وقد شرّفني ربي بالانتساب إليها، ووفّقني أيضا للالتحاق بقسم أصول الفقه فيها، والحمد لله أولا وآخرا. ثم إنه لما كان مطلوبا مني نشر بحث موجز قبل تسليم بحثي في الدكتوراه عزمت أن يكون عنوان البحث المطلوب مني نشره: دراسة في الأقوال المتفقة حكما المختلفة مأخذا في حكم الانتفاع بالأشياء قبل ورود الشروع. The science of Usul al-Fiqh is to the Shari'ah as the science of grammar is to the Arabic language. Through it, legal rulings are derived, and through it, the degrees of interests are known when there is conflict, and the depths of corruption when there is conflict, and through it, the correct fatwas are distinguished from the corrupt ones. Allah has provided for it unique men who have spent their precious lives on it throughout the ages; in service of the religion of Islam; and keenness to understand the meaning of the Book of Allah and the Sunnah of His Prophet Muhammad - may Allah's prayers and peace be upon him - with a sound understanding, until it has reached our present era, the era of specializations and universities, headed by the Islamic University in Medina, that university whose outputs have illuminated the earth, and the burden of its students has been good as the mineral of its soil has been good. My Lord has honored me by joining it, and has also granted me success in joining the Department of Usul al-Fiqh in it, and praise be to Allah first and last. Then, since I was required to publish a brief research before submitting my doctoral research, I decided that the title of the research I was required to publish would be: A Study of the Statements that are in agreement in ruling but differ in their sources regarding the ruling on benefiting from things before the beginning of the act. | ||||
