| Abstract | ||||
| تظهر أهمية البحث من خلال أمور عديدة، فهذا البحث يعالج أحد مسائل الاجتهاد والتقليد، التي تشّكل أحد أرباع موضوعات علم أصول الفقه. كما أن هناك حاجة لبيان هذه المسألة وإفرادها بالبحث؛ لوقوع بعض الخلط في هذه المسألة، ولِما ذُكر على ما ترتّب على هذه المسألة من المسائل، ثم بيان أصل هذه المسألة وأهمية إرجاعها إلى ما ذكره الأصوليون من الأصول. ويهدف الباحث في بحثه هذا إلى عدد من الأمور، منها: بيان حكم اجتهاد الرسول ﷺ عقلاً وشرعاً وتحرير محل النزاع في المسألة ، وذكر ثمرة الخلاف في المسألة ، وبيان الأصول التي ترجع لها مسألة اجتهاد الرسول ﷺ، وما بُنيت عليه من المسائل. The importance of the research appears through many things. This research addresses one of the issues of ijtihad and imitation, which constitute one of the quarters of the topics of the science of jurisprudence. There is also a need to clarify this issue and discuss it separately. Because there was some confusion in this issue, and because of the issues that resulted from this issue, then explaining the origin of this issue and the importance of returning it to the principles mentioned by the fundamentalists. In this research, the researcher aims to do a number of things, including: Explaining the ruling on the ijtihad of the Messenger, peace and blessings of God be upon him, both rationally and legally, and clearing up the area of dispute in the issue, mentioning the fruit of the disagreement in the issue, and explaining the principles to which the issue of the ijtihad of the Messenger, peace and blessings of God be upon him, is based, and the issues on which it was built. | ||||
