| Abstract | ||||
| استقر الفقه الجنائي المعاصر على مبدأ شرعية الجرائم والعقوبات، وهو يقضي بأن تكون الأفعال محل التجريم محددة مسبقا، وكذلك العقوبات المقررة عليها منصوص عليها، ومع نشأة هذا المبدأ القانوني تم تطبيقه حرفيا، مما أدى إلى تقييد سلطة القاضي الجنائي في النظم القانونية المعاصرة، فأصبح دوره مقتصرا على مجرد تطبيق النص، وإنزال العقوبة المقدرة والمقررة سلفا، مع عدم قدرته على الموازنة بين الجريمة والعقوبة، أو مراعاة الجاني، في حين أن بنية النظام الجنائي الإسلامي فيما يتعلق بالتعازير تترك مجالا واسعا لكل من ولي الأمر والقاضي في تجريم بعض الأفعال وتقدير العقاب المناسب لها، تبعا لظروف وملابسات ارتكاب الجريمة، وكذلك مراعاة حالة الجاني ، مع تقييد هذه السلطة بضوابط وقيود شرعية، هذه النتيجة التي أقرها الفقه الجنائي الإسلامي هي ما تسير إليه النظريات الحديثة في الفقه الجنائي المعاصر ، لذا فإن هذا البحث يحاول تسليط الضوء على حدود سلطة التجريم والعقاب في التعازير في ظل مبدأ شرعية الجرائم والعقوبات المنصوص عليه في القوانين المعاصرة، وقد خلص البحث إلى تميز النظام الجنائي الإسلامي عن النظم القانونية المعاصرة فيما يتعلق بتقسم الجرائم والعقوبات، وكذلك منحه سلطة لولي الأمر والقاضي في تجريم بعض الأفعال التي قد تشكل تهديدا لأمن المجتمع، أو تضر بالمصلحة العامة، وتقدير العقاب المناسب عليها، وقد اقتضى هذا البحث استخدام المنهج التاريخي لبيان لنشأة هذا المبدأ في النظم القانونية المعاصرة، وكذلك المنهج الوصفي والاستقرائي والمنهج التحليلي والمنهج المقارن من خلال ذكر الآراء الفقهية والقانونية وعرضها حسب سياق البحث، ثم تحليل ونقد هذه الآراء والترجيح بينها في بعض المواضع، مع المقارنة بين أقوال المذاهب الإسلامية، والنظم القانونية المعاصرة. Contemporary criminal jurisprudence has established the principle of legality of crimes and punishments, which stipulates that criminalized acts must be pre-determined, along with the corresponding penalties explicitly stated. With the emergence of this legal principle, it has been applied literally, which has restricted the authority of the criminal judge in contemporary legal systems. Consequently, the judge's role is limited to merely applying the written law and enforcing pre-determined penalties, without the ability to balance between the crime and its punishment or to consider the circumstances of the offender. In contrast, the structure of the Islamic criminal system regarding ta'zir punishments allows significant discretion for both the ruler and the judge to criminalize certain acts and determine appropriate punishments based on the circumstances of the crime and the condition of the offender. However, this authority is constrained by specific Sharia-based regulations and limits. This conclusion, established in Islamic criminal jurisprudence, aligns with modern theories in contemporary criminal law. This research seeks to shed light on the limits of criminalization and punishment authority in ta'zir within the framework of the principle of legality of crimes and punishments as stipulated in contemporary legal systems. The study concluded that the Islamic criminal system is distinct from modern legal systems in its classification of crimes and punishments and in granting discretionary authority to the ruler and judge to criminalize acts that may pose a threat to societal security or harm public interest, while determining suitable punishments. The research adopted the historical method to explain the emergence of this principle in modern legal systems, as well as descriptive, inductive, analytical, and comparative methodologies by presenting juristic and legal opinions, analyzing and critiquing them, and favoring the strongest views. | ||||
