Abstract | ||||
هذا الموضوع يتحدَّث عن آراء القاضي أبي يوسف يعقوب بن إبراهيم[ت:182هـ] المتعلِّقة بأحكام فقه المعاملات الماليَّة، والَّتي انفرد بها في المذهب الحنفيِّ، ودراستها دراسةً فقهيَّةً مقارِنةً في المذهب نفسِهِ، مع بيان أثر هذا الاختلاف في المفتَى به. وتتَّضح أهمِّيَّة هذا الموضوع من حيثُ تعلُّقُهُ بإحدى الضَّروريَّات الخمس الَّتي اتَّفقت جميع الشَّرائع على حفظها، وبيان أهمِّيَّة هذه الشَّخصيَّة العظيمة في المذهب الحنفيِّ، وأثرِ آرائه رحمه الله في الفتاوى المعتَمَدَة لدى المذهب؛ كونَهُ أوَّلَ من تولَّى منصب قاضي القُضاة، وأحدَ أركان المذهب الحنفيِّ وأسُسِهِ. وكذلك فإنَّ هذا البحث سييسِّر البحث للمشتغلين في القضاء وما يتعلَّق بالمعاملات الماليَّة ببيان الآراء المختَلِفَة في المذهب الحنفيِّ في هذا المجال. ويُتوقَّع أن يصل الباحث إلى جمعِ المسائل المتعلِّقَة بآراء القاضي أبي يوسف في باب المعاملات الماليَّة، والَّتي انفرد بها في المذهب الحنفيِّ، وبيانِ أثرها في المذهب، وخدمةِ المذهب الحنفيِّ بدراسة الأقوال المعتمدة فيه في باب المعاملات الماليَّة، وبيان شموله وسَعَتِهِ، وخدمة القضاء والمشتغلين فيه ببيان الآراء المتعلِّقَة بباب المعاملات الماليَّة في المذهب الحنفيِّ. Abstract: This topic talks about the views of Judge Abu Yusuf Yaqoub bin Ibrahim (d.182 h) related to the rulings of the jurisprudence of financial transactions that he was unique in the Hanafi school, and its study is a comparative jurisprudential study in the Hanafi school, with an explanation of the impact of this difference on the fatwa in the same doctrine.The importance of this topic becomes clear in terms of its relation to one of the five necessities that all Shariahs agreed to preserve, and to clarify the importance of this great personality - Judge Abi Youssef - in the Hanafi school of thought, and to explain the impact of his views, may God have mercy on him, in the fatwas approved by the doctrine, as he was the first to assume the position of Judge. One of the pillars of the Hanafi school and its foundations.Also, this research will facilitate the research for those engaged in the judiciary and the jurisprudence of financial transactions by clarifying the different opinions in the Hanafi school of jurisprudence of financial transactions.The results expected to be reached: a collection of issues related to the opinions of Judge Abi Youssef in the chapter on financial transactions that were unique to the Hanafimadhhab, and an explanation of its impact on the madhhab, and the service of the Hanafimadhhab by studying the statements adopted in it in the chapter on transactions and a statement of its comprehensiveness and capacity, and serving the judiciary and those working in it by stating the opinions related to the chapter.
