Abstract
إن مفهوم التخريج المقاصدي يعبر عن عملية فقهية تهدف إلى استنباط الأحكام الشرعية للمسائل الجديدة انطلاقًا من المقاصد العامة للشريعة الإسلامية، ويستند هذا المفهوم إلى فهم شامل للنصوص الشرعية المتمثلة في القرآن الكريم والسنة النبوية، وتطبيقها على المسائل المعاصرة بما يحقق أهداف الشريعة ومقاصدها الكلية، و يركز التخريج المقاصدي على البحث عن المصالح التي تقوم عليها الأحكام، وتطبيقها بما يتناسب مع تحديات العصر ومستجداته، دون التقيد بالنصوص بشكل جامد يغفل الواقع المعيش والتغيرات التي تطرأ على المجتمع. التخريج المقاصدي يوفر مرونة لتطبيق الشريعة بشكل يتناسب مع المستجدات والتحديات المعاصرة، مع إعطاء الأولوية لتعظيم المصالح العامة وتقليل المفاسد، ويشمل ذلك تقدير المصالح والمفاسد في المسائل المستجدة وإيجاد توازن بين النصوص الشرعية والواقع العملي، بما يحقق مصلحة الأمة ويقدم حلولا فقهية للمسائل الجديدة. الخطوات المتبعة في التخريج المقاصدي تبدأ بتحديد المقاصد العامة للشريعة، ثم تحديد القضية أو المسألة المعاصرة والرجوع إلى النصوص الشرعية ذات الصلة، تحليل هذه النصوص وفقا للمقاصد الشرعية، النظر في مآلات الأفعال والتداعيات المحتملة، وأخيرا استخلاص الحكم الشرعي المناسب. أدوات التخريج المقاصدي تتنوع ما بين التفسير والتأويل لفهم النصوص الشرعية، استخدام القياس والعقل، دراسة المقاصد والاعتماد على الإجماع، مع الأخذ بالمصالح المرسلة والعرف، والنظر في المآلات لتحقيق توازن بين الأحكام الشرعية ومقاصدها. من خلال استخدام هذه الأدوات والخطوات، يمكن للفقهاء والمجتهدين التعامل مع المسائل الجديدة بطريقة مبتكرة ومرنة تحقق أهداف الشريعة وتواكب تطورات العصر، مما يسهم في تعزيز العدالة والسلام والتنمية المستدامة في المجتمعات الإسلامية وغيرها. من خلال تطبيق عملية التخريج المقاصدي على قانون مكافحة التمييز والكراهية والتطرف بدولة الإمارات يمكن القول بأنه يتوافق تماما مع قواعد الشريعة الإسلامية. Abstract: The concept of purposive graduation expresses a jurisprudential process that aims to derive legal rulings for new issues based on the general objectives of Islamic law. This concept is based on a comprehensive understanding of the legal texts represented in the Holy Quran and the Sunnah of the Prophet, and their application to contemporary issues in a way that achieves the objectives and overall objectives of the Sharia. Purposive graduation focuses on searching for the interests on which the rulings are based, and applying them in a way that is consistent with the challenges and developments of the era, without being bound by the texts in a rigid manner that ignores the lived reality and changes that occur in society. Purposive graduation provides flexibility to apply the Sharia in a way that is consistent with contemporary developments and challenges, while giving priority to maximizing public interests and reducing corruption. This includes assessing the interests and corruptions in emerging issues and finding a balance between the legal texts and practical reality, in a way that achieves the interest of the nation and provides jurisprudential solutions to new issues. The steps followed in the purposive graduation begin with identifying the general purposes of Sharia, then identifying the contemporary issue or matter and referring to the relevant Sharia texts, analyzing these texts according to the Sharia purposes, considering the consequences of actions and possible repercussions, and finally extracting the appropriate Sharia ruling. The tools of purposive graduation vary between interpretation and explanation to understand Sharia texts, using analogy and reason, studying the purposes and relying on consensus, taking into account the public interest and custom, and considering the consequences to achieve a balance between Sharia rulings and their purposes. By using these tools and steps, jurists and mujtahids can deal with new issues in an innovative and flexible way that achieves the objectives of Sharia and keeps pace with the developments of the era, which contributes to promoting justice, peace and sustainable development in Islamic societies and others. By applying the purposive graduation process to the law to combat discrimination, hatred and extremism in the UAE, it can be said that it is fully consistent with the rules of Islamic Sharia.
