| Abstract | ||||
| يتناول البحث دراسة وتحليل موقف النيابة العامة ممثلة في نيابة شئون الأسرة حاليا في مجال المنازعات الأسرية أمام محكمة الأسرة . ويمعن البحث في تأصيل سلطة النيابة العامة في رفع الدعاوى الأسرية والتدخل فيها والطعن على الأحكام التي تصدر بشأنها ، مراعاة لجانب الصالح العام والحفاظ على المصالح العليا في المجتمع. كما يتابع البحث ما لحق بسلطة النيابة العامة من تطورات إجرائية في نطاق الدعاوى المتعلقة بمسائل الأحوال الشخصية، ويعمل على تقييم هذه التطورات وبيان مدى فائدتها. ويكشف البحث عن مدى مطابقة التطورات الإجرائية لسلطة النيابة العامة في دعاوى الأسرة لقواعد وأحكام الفقه الإسلامي وعدم الاصطدام بها. The research deals with studying and analyzing the current position of the Public Prosecution, represented by the Family Affairs Prosecution, in the field of family disputes before the Family Court. The research focuses on establishing the authority of the Public Prosecution to file family lawsuits, intervene in them, and appeal the rulings issued in their regard, taking into account the public interest and preserving the highest interests in society. The research also follows up on the procedural developments that have occurred to the Public Prosecution Authority in the scope of lawsuits related to personal status matters, and works to evaluate these developments and indicate the extent of their usefulness. The research reveals the extent to which the procedural developments of the Public Prosecution Authority in family lawsuits conform to the rules and provisions of Islamic jurisprudence and do not conflict with them | ||||
