| Abstract | ||||
| الحمد لله وبعد: فهذا البحث يتناول الأمر الوارد في صورة الخبر وتأثير ذلك علي الحكم الشرعي وحيث إن الإنشاء يختلف عن الخبر في مدلوله ومعناه عرفت الإنشاء وأقسامه وما هو متفق فيه بين العلماء وما هو مختلف فيه بجملة موجزة ثم تكلمت عن الخبر وتعريفه والفروق الواقعة بينهما، ثم تكلمت عن الأمر وماهيته وصيغته وأنه من أقسام الإنشاء، ثم تكلمت عن مجيئه في صورة الخبر والحكمة من مجيء الأمر في صورة الخبر، ثم بينت أن الأمر لا يتأثر بمجيئه في صورة الخبر من حيث الوجوب إلا بقرينة، ومن حيث النسخ فقد يدخله النسخ وإن كان في صورة الخبر ومعلوم أن الراجح عند العلماء أن النسخ لا يدخل الخبر وثبت من هذا البحث أن الحكم لا يتأثر بكون الأمر قد جاء في صورة الخبر بل قد يكون ذلك للبلاغة التي يتميز بها الدليل الشرعي عموما أو قد يكون ذلك سببه اهتمام الشارع بالحكم من حيث اللزوم ، ثم أنزلت بعض الفروع الفقهية علي هذه القاعدة بداية من العبادات مرورا بالمعاملات ثم انتهيت بهذه الفروع في الجنايات، ثم ختمت ذلك بنتائج أهمها: تميز الشريعة بسعة الاستنباط وتنوعه بدليل بناء الأحكام علي ما هو في صورة الخبر ولا يتوقف الاستنباط عند الإنشاءات. Praise be to Allah, and after: This research discusses the command that appears in the form of a statement and its impact on legal rulings. Since imperative speech differs from declarative speech in its meaning and implication, I have defined imperative speech, its types, and what is agreed upon amongscholars and what is disputed in a concise manner. Then, I discussed declarative speech, its definition, and the differences between the two. I then addressed the concept of command, its nature, and its linguistic forms, clarifying that it falls under imperative speech. Furthermore, I examined instances where the command appears in the form of a statement and the wisdom behind this occurrence. I also demonstrated that the obligatory nature of a command is not affected by its appearance in the form of a statement unless there is an accompanying contextual indicator. As for abrogation, it may apply to a command even if it appears as a statement, despite the predominant scholarly view that abrogation does not apply to declarative speech. Thisstudy establishes that legal rulings are not affected by whether a command comes in the form of a statement; rather, this may serve rhetorical purposes inherent in legal discourse or reflect the legislator's emphasis on the ruling's binding nature.I then applied this principle to various jurisprudential cases, starting with acts of worship, followed by transactions, and concluding with criminal law. Finally, I summarized the key findings, the most significant of which is that Islamic law is distinguished by its breadth and diversity in reasoning, as evidenced by the derivation of rulings from statements appearing in the form of declarations rather than being confined to imperative speech. | ||||
