| Abstract | ||||
| يتناول البحث التزام شركة المشروع التي تعاقدت معها الدولة بتنفيذ عقود الإنشاءات ذات الدولي والأثر المترتب على الإخلال به، وقد اشتمل البحث على مقدمة تناولت فيها التعريف بالموضوع وأهميته ومشكلته وأهدافه وخطة البحث، ثم تمهيد كان فيه التعريف بعقد الإنشاءات ذات الطابع الدولي وأهم مميزاته وعيوبه ثم تطرق البحث إلى بيان أهم التزام للشركة المتعاقدة مع الدولة، وهو تنفيذ المشروع بحالة جيدة والمحافظة عليه حتى يظل بحالته الجيدة ثم العمل على تسليمه للدولة في الوقت المحدد، والتزامها بتنفيذ المشروع بصفة شخصية وعدم التنازل عنه للغير صراحة أو من الباطن إلا بموافقة الدولة صاحبة المشروع، وكذا التزامها بالتنفيذ حسب ما ورد في كراسة الشروط والمواصفات التي تمت المناقصة بناء عليها، ثم تطرق البحث إلى الأثر المترتب على الإخلال بهذا الالتزام، وحق الدولة في مطالبة الشركة بتنفيذ العقد المبرم بينهما أو مطالبتها بالتعويض عند التوقف عن تنفيذ المشروع، وذلك حسب نوع التوقف والأسباب التي أدت إليه، فهو في حالة القوة القاهرة مختلف عن الحالة الطبيعية، ثم ختمت البحث بأهم النتائج. This research addresses the obligation of the project company contracted by the state to implement international construction contracts and the consequences of failing to do so. The research includes an introduction discussing the topic's definition, importance, problem, objectives, and research plan. A prelude follows, defining international construction contracts, their main features, and drawbacks. Then, the research highlights the most crucial obligation of the contracting company: executing the project in good condition, maintaining it in its proper state, and delivering it to the state on time. The company must implement the project personally and cannot transfer it to others explicitly or covertly without the state's approval. Furthermore, the research examines the consequences of breaching this obligation and the state's right to demand either contract fulfillment or compensation, depending on the nature of the breach and its causes. The state's stance varies between force majeure situations and ordinary contractual breaches. The research concludes with key findings. | ||||
