| Abstract | ||||
| من ينظر في أحكام الشريعة الإسلامية يلحظ اهتمامها وترسيخها لقواعد العدل ، وأسس العدالة الإجتماعية ، فهي شريعة وسطية تحافظ علي الإنسان المسلم في سائر حياته ، قائمة علي العدل بين عباده ، ورحمته بين خلقه . وقد عنيت الشريعة الإسلامية عناية فائقة بما يحقق المحافظة علي كيان المجتمع بما يصلح الناس في عقولهم ، وأموالهم ، وأحوالهم ، كما عنيت أيضًا بما يحقق مصالح الناس ويدعو إلي الاستقرار. ويعد من أخصب هذه الأدلة قديمًا وحديثًا المصلحة ، لاسيما في الآراء التي لا نص فيها عند من يقولون بحجيتها خاصة في المذاهب الفقهية الأربعة. وقضية الفقر من القضايا التي ذخرت باهتمام كبير في الفقه الإسلامي، فلقد جلاها الفقهاء، وبنوا العديد من الأحكام التي تتعلق بالفقير، وقد وضع بعضهم نصب أعينهم في إرساء تلك الأحكام المرجوة للفقير، فما كانت أقوالهم إلا اعتبارً لتلك المصلحة. لذا أوجد الإسلام العديد من السبل لمكافحة الفقر ؛ بل سعى في توضيح الأحكام التي تحقق المصلحة الذي تغنيه عن السؤال، ففرضت الزكاة ؛ لتلبي ظمأ الفقير، حيث إنها ليست من باب الإحسان التطوعي، وإن كان الإحسان أجلى مظاهرها، وتهدف هذه الدراسة إلي إلقاء الضوء علي الآراء التي قال فيها الفقهاء لمصلحة الفقير ، وكيف راعي الفقهاء الفقير في أقوالهم الفقهية بما يناسب المصلحة، فالبحث يُبرز العلل ، والمقاصد من خلال أقوال الفقهاء الذين قالوا في فتواهم لمصلحة الفقير استنادًا علي المصلحة، وقد اتسم البحث بالمنهج الاستقرائي ، وذلك باستقراء النصوص من مظانها، كما استخدمت المنهج التحليلي؛ لتحليل تلك النصوص، وتوجيهها إلى علة البحث وهو بيان المصلحة، أو بالأحرى بيان المصلحة من خلال تلك الأحكام المتعلقة بالفقير والربط بين الأصل والفرع ، ثم إتباع الطريقة الأكاديمية والمنهجية المثلي في العرض الفقهي ، والتخريج للأحكام الفقهية ، والأحاديث النبوية ، وآراء الفقهاء . وقد توصل الباحث إلي عدة نتائج من أهمها أن الفقير أسوأ حالا من المسكين لذ اخترته ليكون عنوان البحث ، وسقت الأدلة علي ذلك وجعلته محورًا للحديث عن الاحكام المتعلقة به . رجح البحث قول الشافعية والحنابلة في تعريف للفقير ، وتفريقهم بين الفقير والمسكين ، والألفاظ ذات الصلة . أن هناك حد للفقير الذي يحتاج به الزكاة هو سد حاجاته الأساسية على ما جرت به العادة والعرف، فإن كان ما يتحصل عليه الفقير من دخل لا يكفي حاجاته الأساسية وحاجة من تلزمه نفقته فهو فقير، والحاجات الأساسية هي المطعم، والملبس، والمسكن، وسائر ما لا بد له منه، بغير إسراف، ولا تقتير، للفقير نفسه، ولمن يعولهم. يرجح البحث القول بالتعليل في الأحكام وذلك لوجود التعليل الصريح والضمني في الكتاب والسنة ، وكذلك قول بعض الأصوليين. Anyone who examines the provisions of Islamic law will notice its emphasis on and consolidation of the principles of justice and the foundations of social justice. It is a moderate law that protects the Muslim person throughout his life, based on justice among His servants and mercy among His creation. Islamic law has devoted great attention to preserving the integrity of society by improving people's minds and wealth. It also focused on what achieves people's interests and calls for stability. The most fertile of these arguments, both ancient and modern, is the concept of public interest, especially in the opinions that lack a textual basis for its validity, particularly in the four schools of Islamic jurisprudence. The issue of poverty is one of the issues that has received great attention in Islamic jurisprudence. Jurists have clarified it and established numerous rulings related to the poor. Some of them have established Some of them set their sights on establishing these desired provisions for the poor, and their statements were based solely on consideration of this interest. Therefore, Islam created numerous ways to combat poverty; indeed, it sought to clarify the provisions that achieve the desired interest, eliminating the need for begging. Zakat was imposed to satisfy the thirst of the poor, as it is not a form of voluntary charity, even though charity is its most obvious manifestation. This study aims to shed light on the opinions expressed by jurists regarding the interests of the poor. How did the jurists take the poor into consideration in their jurisprudential statements in a way that suits the interest? The research highlights the reasons and objectives through the statements of the jurists who said in their fatwas for the interest of the poor based on the interest. The research was characterized by the inductive method, by inducting texts from their sources. It also used the analytical method to analyze those texts and direct them to the reason for the research, which is explaining the interest, or rather explaining the interest through those rulings. Related to the poor and the connection between the root and the branch, then following the academic and methodological approach in presenting jurisprudential knowledge, and deriving jurisprudential rulings, prophetic hadiths, and the opinions of jurists. The researcher reached several conclusions, the most important of which is that the poor are in a worse situation than the needy. Therefore, I chose this as the title of the research, presented evidence for this, and made it the focus of the discussion of the rulings related to it. Related to the poor and the connection between the root and the branch, then following the academic and methodological approach in presenting jurisprudential knowledge, and deriving jurisprudential rulings, prophetic hadiths, and the opinions of jurists.
