| Abstract | ||||
| يهدف البحث إلى بيان مفهوم المقاصد الحاجية في الشريعة الإسلامية، ودورها في الإستدلال الفقهي والإجتهاد، بإعتبارها أحد مراتب المقاصد الشرعية الثلاث: الضروريات، الحاجيات، والتحسينيات. والتي تهدف إلى رفع الحرج دون بلوغ حدّ الضرورة. تناولت الدراسة تعريف الحاجيات وخصائصها وموقعها ضمن بنية المقاصد الشرعية،، وإعتبارها ضابطًا في تحقيق المناط وتنزيل الأحكام. وركّزت الدراسة على كيفية توظيف المقاصد الحاجية في الإجتهاد الفقهي من خلال الترجيح بين الأقوال وتحقيق المناط وتنزيل الأحكام، مع عرض نماذج فقهية واقعية، خصوصًا في فقه النوازل والفتاوى المعاصرة.إعتمد البحث المنهج التحليلي المقارن لتحليل النصوص الفقهية المتعلقة بالمقاصد الحاجية، ومقارنة الآراء الفقهية المختلفة ،إلى جانب المنهج الإستنباطي لتفسير تطبيقاتها في الإجتهاد. وتوصل البحث إلى نتائج أبرزها: أهمية المقاصد الحاجية في تحقيق التوازن بين الأحكام الشرعية ومتغيرات والواقع الإجتماعي والإقتصادي، وضرورة ضبطها بالمصلحة الشرعية لتجنب التوسع غير المنضبط في التيسير، والحفاظ على الضروريات. كما أبرز أهمية مراعاة تفاوت البيئات والأفراد في الإجتهاد الفقهي، ودور الحاجيات في التعامل مع النوازل المعاصرة. وأكدَ البحث على أن الإعتدال في توظيف الحاجيات يعزز من فعالية الفقه ويسهم في التيسير وتحقيق مقاصد الشريعة دون الإخلال بالضروريات او الثوابت الشرعية . This research aims to clarify the concept of ḥājiyyāt (complementary necessities) in Islamic law and their role in legal reasoning and ijtihād, as one of the three levels of Maqāṣid al-Sharī‘ah: necessities (ḍarūriyyāt), needs (ḥājiyyāt), and embellishments (taḥsīniyyāt). The ḥājiyyāt aim to alleviate hardship without reaching the level of necessity. The study discusses the definition, characteristics, and position of ḥājiyyāt within the structure of Islamic objectives, considering them as a criterion in realizing legal applicability (taḥqīq al-manāṭ) and implementing rulings. It focuses on how ḥājiyyāt are employed in legal reasoning through weighing juristic opinions and contextualizing rulings, with practical jurisprudential examples—particularly in contemporary fatwas and legal cases.The research adopts an analytical-comparative methodology to examine juristic texts related to ḥājiyyāt and compare different scholarly perspectives. It also employs the deductive method to interpret their applications in the process of ijtihād.The findings emphasize the importance of ḥājiyyāt in achieving a balance between Islamic rulings and socio-economic realities, while stressing the need to regulate them within the framework of maṣlaḥah (public interest) to avoid uncontrolled leniency and preserve essential objectives. The study highlights the importance of considering social and individual differences in legal reasoning and the significant role of ḥājiyyāt in addressing contemporary legal issues. It concludes that moderation in applying ḥājiyyāt enhances legal flexibility and facilitates achieving the objectives of Sharī‘ah without compromising its core values. | ||||
