| Abstract | ||||
| الملخص يتناول هذا البحث مسألة من المسائل الفقهية المعاصرة , ألا وهي مسألة : ( زواج المسيار) ؛ فيعرض باختصار لبيان مفهوم زواج المسيار , وآراء الفقهاء المعاصرين في حكمه الشرعي , وأدلتهم , ويعرض – أيضًا – لرأي الخبراء والمختصين من علماء النفس والاجتماع في هذه المسألة , ثم سبب الخلاف في الحكم على المسألة وبيان الرأي الراجح . ويخلص البحث إلى ترجيح القول : بالمنع من زواج المسيار ؛ بناء على ما رصدته الدراسات الميدانية التي أجراها علماء النفس والاجتماع لمآلات زواج المسيار؛ وذلك لأن واقع زواج المسيار شاهد على ما يترتب على هذا الزواج من مفاسد تتعلق بالمرأة وبالأطفال الذين هم نتاج هذا الزواج . Summary This research deals with one of the contemporary jurisprudential issues, which is the issue of: (misyar marriage); It briefly presents an explanation of the concept of misyar marriage, the opinions of contemporary jurists regarding its legal ruling, and their evidence. It also presents the opinion of experts and specialists from psychologists and sociologists on this issue, then the reason for the disagreement in ruling on the issue and a statement of the preponderant opinion. The research concludes that the opinion is more likely: prohibiting misyar marriage. Based on what was observed by field studies conducted by psychologists and sociologists regarding the consequences of misyar marriage; This is because the reality of misyar marriage is evidence of the evils that this marriage entails related to the woman and the children who are the product of this marriage. | ||||
