| Abstract | ||||
| ملخص البحث: يتناول هذا البحث قضية فقهية دقيقة تتعلق بالرجوع غير المشهور عند أئمة المذاهب الفقهية الأربعة في بابي الطهارة والصلاة، حيث يعتمد على دراسة أقوالهم في هذين البابين وتحليل الرجوع عنها، مع وضع ضابط لعدم الشهرة، ثم دراسة المسائل التي لم يُشتهر الرجوع عنها، ومقارنتها وتحليلها، وبيان أسباب عدم شهرتها، وما يترتب على ذلك من آثار فقهية. وقد تم تنظيم البحث في مقدمة، ومبحثين، وخاتمة، حيث تناولت المقدمة أهداف البحث، ومشكلته، ومنهجه، وخطته. أما المبحث الأول، فقد خصص لبيان ماهية الرجوع الفقهي غير المشهور عند أئمة المذاهب الأربعة، في حين تطرق المبحث الثاني إلى دراسة المسائل التي لم يُشتهر الرجوع عنها عند أئمة المذاهب الأربعة في بابي الطهارة والصلاة، وتم تقسيمه إلى أربعة مطالب، حيث تناول كل مطلب مسائل إمام من الأئمة الأربعة. وقد اختُتم البحث بخاتمة تضمنت أهم النتائج والتوصيات، وكان من أبرز التوصيات ضرورة تأليف موسوعات شاملة تجمع حالات رجوع أئمة المذاهب الفقهية، لتنال شهرة واسعة كتلك التي تحظى بها كتب الإجماع، بحيث لا يُفتى بقول تم الرجوع عنه كما لا يُفتى بخلاف المجمع عليه. كما أوصى البحث بأن يكون من شروط الاجتهاد والإفتاء معرفة أحكام الرجوع الفقهي، أو إضافتها إلى شرط معرفة الناسخ والمنسوخ، نظرًا لكون القول المرجوع عنه في حكم المنسوخ. وأكدت التوصيات على أهمية توجيه المؤسسات العلمية والبحثية لدراسة قضايا الرجوع الفقهي وآثاره، وجمع النتاج العلمي في هذا المجال ونشره، تحقيقًا لمزيد من الدقة في تحرير المذاهب الفقهية وصيانة التراث الفقهي. كما شدد البحث على ضرورة اهتمام الباحثين بتحقيق التراث الفقهي والتعمق في دراسته بنفس القدر الذي يولونه لمسائل النوازل، وذلك استنادًا إلى مقولة ابن عبد البر في كتابه "جامع بيان العلم وفضله": "لا يكون فقيهًا في الحادث من لم يكن عالمًا بالماضي"." Abstract This research addresses a precise jurisprudential issue concerning non-prevalent retraction among the leading scholars of the four Islamic schools of thought in the chapters of purification and prayer. It examines their statements in these areas، analyzing instances of retraction while establishing a criterion for non-prevalence. The study focuses on cases where retraction is not widely recognized، comparing and analyzing them، identifying reasons for their lack of recognition، and exploring their jurisprudential implications. The research is structured into an introduction، two main sections، and a conclusion. The introduction outlines the research objectives، problem statement، methodology، and structure. The first section defines the nature of non-prevalent juristic retraction among the scholars of the four schools، while the second section studies specific cases of unrecognized retraction in the chapters of purification and prayer، dividing the discussion into four subsections، each dedicated to the rulings of one of the four jurists. The study concludes with key findings and recommendations. Among the most notable recommendations is the need to compile comprehensive encyclopedias documenting the instances of retraction among juristic scholars، granting them prominence similar to books on scholarly consensus so that rulings based on retracted opinions are avoided، just as rulings contradicting consensus are not issued. The research also recommends that knowledge of juristic retraction be a requirement for scholars issuing legal rulings، either as an independent condition or as part of their understanding of abrogation and its implications، given that a retracted opinion is effectively akin to an abrogated ruling. Furthermore، the study highlights the importance of academic and research institutions directing scholars toward studying juristic retraction، its branches، and its jurisprudential consequences، as well as compiling and publishing scholarly works on the subject to enhance the accuracy of juristic scholarship and preserve Islamic legal heritage. Lastly، the study stresses the necessity for researchers to dedicate as much effort to studying and analyzing historical juristic traditions as they do to contemporary legal issues، drawing from Ibn Abd al-Barr’s statement in Jāmiʿ Bayān al-ʿIlm wa Faḍlih: "One cannot be a jurist in contemporary issues without knowledge of past rulings. | ||||
