| Abstract | ||||
| مفهوم الظاهر من المفاهيم التي اهتم بها العلماء قديماً وحديثاً، وإن مما اشتهر به ابن حزم اعتماده على الظاهر في استنباط الأحكام الفقهية، وعدم مخالفته هذا الظاهر إلا في أضيق الحدود، وهذا على خلاف طريقة الجمهور فإنهم يهتمون بالظاهر، ولكن يخالفونه إذا وجد المقتضي الصحيح من قياس أو نص أو غيره. وقد احتوى البحث على مسائل الطهارة التي لم يأخذ ابن حزم فيها بالظاهر، وهي سبع مسائل، وجعل الباحث في كل مسألة ثلاثة مطالب: الأول في قول الإمام ابن حزم وأدلته، والثاني في دليل المسألة، وتحديد ظاهره عند الإمام ابن حزم، والثالث في الظاهر المخالِف لقول الإمام ابن حزم. وقد تبين من خلال دراسة المسائل محل البحث أن ابن حزم قد خالف مفهوم الظاهر عنده في بعض تلك المسائل، وأما بعضها الآخر فقد خالف مفهوم الظاهر عند غيره -من الجمهور أو غيرهم، وأسباب المخالفة متعددة مبينة في محلها. The apparent meaning is one of the concepts that both past and modern scholars have focused on. One of the most famous things about Ibn Hazm is his reliance on apparent meaning in deriving Fiqh rulings and his refusal to contradict this apparent meaning except in very limited circumstances. This contrasts with the approach of the majority, who pay attention to apparent meaning but deviate from it when a valid reason is found, such as analogy, a text, or other evidence. The research covers seven issues of purification in which Ibn Hazm did not rely on the apparent meaning. The researcher divided each issue into three sections: the first is the statement of Imam Ibn Hazm and his evidence; the second is the evidence for the issue, defining its apparent meaning according to Imam Ibn Hazm; and the third is the apparent meaning that contradicts Ibn Hazm's statement. The examination of the issues showed that Ibn Hazm differed from his understanding of the apparent meaning in some of these issues. Moreover, he differed from the apparent meaning of others, both the majority and others, on some other issues. The reasons behind this divergence are numerous and are explained in their proper place. | ||||
