| Abstract | ||||
| تأتي الأهمية العلمية لدراسة الإضافات التجديدية في "علم أصول الفقه" من خلال جمع مشكلات التجديد في أصول الفقه ضمن دراسة أكاديمية تبدأ من قراءة واقع علم الأصول، ومحاولة الربط بينه إلى العلم الموروث، وتعديل مساره بما يضمن استمرار فاعليته كأداة منهجية قادرة على مواجهة التطورات. ومن أبرز الأسباب لاختياري هذا الموضوع: أولاً: اليقين بأن تجديد العلوم الشرعية بما يحقق مقصدها في حفظ الدين وتمكينه، وينبغي أن يكون من أولويات العقل الفقهي المعاصر حتى يستأنف المسار الاجتهادي الذي يعد علم الفقه أداته الأساسية. ثانياً: معرفة جهود الإمام الشاطبي في تجديده علم الفقه فهو يعتمد على تحديد هدف التجديد المنشود، وبيان وسائل تحقيقه في مبحث الكتاب " القرآن الكريم " ضمن كتابه الموافقات. وتأتي الأهمية العلمية لدراسة التجديد في "علم أصول الفقه من خلال جمع مشكلات التجديد في أصول الفقه ضمن دراسة أكاديمية تبدأ من مبحث القرآن الكريم وما قام به من جهود وإضافات في هذا المبحث زاد بها على غيره من الأصوليين، في محاولة منه لتعديل مسار علم أصول الفقه بما يضمن استمرار فاعليته كأداة منهجية قادرة على مواجهة التطورات. وقد عرضت هذه الدراسة من خلال أربعة مباحث تسبقها مقدمة، وتمهيد، وتليها خاتمة. There has come a swath of time in which the fundamentalist term has been obscured, and its role in the horizons of life related to the civilization succession has been marginalized until God decreed Imam al-Shatibi for him, restricting his life and annexing his estates through moving it from stagnation to the field of creativity, centralizing it and giving it the function of societal reform. It is not guilty that Imam Shatibi had a farsightedness - in the revision of the topics of theology of jurisprudence - ahead of his time and its radiance has continued till nowadays. This view was a renewal that included all the topics of this science especially the discussions of Sharia terminology and provisions. Around this meaning the study revolves. The scientific importance of the study of renewal in the "Science of Fundamentals of Jurisprudence" comes through collecting the problems of renewal in the principles of jurisprudence within an academic study that starts from reading the reality of the science of principles, and trying to link it to inherited science, and adjusting its course in a way that guarantees its continued effectiveness as a methodological tool capable of facing developments. There is a close relation and a strong bond between the Quranic sciences and principles of jurisprudence, thus we found the commentators followed the jurisprudents in various issues. This due to rules of the jurisprudents are general can be used out field of the jurisprudent viewpoints. This assisted by rules of the principles science that composed to explain the legal texts. This explanatory nature of the jurisprudent rules rendered the commentators to enter various jurisprudent view points in the Quranic sciences and gave them rest from refraining and rooting. Reasons for choosing the topic. First: The certainty that renewing Sharia sciences in a way that achieves its goal of preserving and empowering religion should be among the priorities of the contemporary jurisprudential mind so that it resumes the diligent path, of which the science of jurisprudence is its main tool. Second: Developing steps that contribute to a proposed work to renew the science of jurisprudence based on defining the goal of the desired renewal, and indicating the means of achieving it, as well as the procedural steps for its implementation. This study is presented through four topics preceded by an introduction, a preface, and followed by a conclusion. recommendations. | ||||
