| Abstract | ||||
| باستخدام المنهج الاستقرائي والوصفي والتحليلي والنقدي، يهدف هذا البحث إلى استعراض موقف الإمام الجليل أحد كبار أعلام هذه الأمة، الإمام محمد بن إدريس الشافعي وكبار أتباعه البارزين من حجية الإجماع، كما يسعى إلى بيان آرائهم في تأصيله وتحديد مرتبته، ومنهجية التعامل معه، وقد تم تقسيم البحث إلى تمهيد وثلاثة مباحث، حيث خصص التمهيد للتعريف بالإمام الشافعي وكبار أتباعه، والمبحث الأول في تعريف الإجماع في اللغة والاصطلاح، فيما تضمن المبحث الثاني تقرير الإمام الشافعي لحجية الإجماع، والمبحث الثالث كان في تقرير كبار أتباع الإمام الشافعي لحجية الإجماع، وقد توصل البحث إلى عدد من النتائج أهمها: الإجماع لغة: يطلق على معنيين: العزم والاتفاق، أما معناه الاصطلاحي الذي تقل عليه المعارضات فهو: اتفاق مجتهدي أمة محمد بعد وفاته، في عصر من العصور على أمر من الأمور، نقل عن الإمام الشافعي نصوص كثيرة ظاهرها التعارض وبتحقيق المسألة يتبين لنا أنه لا يوجد تعارض بين نصوص الإمام الشافعي الواردة في الإجماع، فهو يقسم الإجماع إلى قسمين: إجماع قطعي وإجماع ظني، يعامل الإمام الشافعي الإجماع القطعي معاملة الحديث المتواتر، ويعامل الإجماع الظني معاملة حديث الآحاد، فكلا القسمين حجة عنده، يرى الإمام الشافعي ضرورة الاعتماد على مستند عند انعقاد الإجماع، يرى الإمام الشافعي ضرورة الاعتماد على مستند عند انعقاد الإجماع، الإجماع هو أحد مصادر الاستدلال المتفق عليها في الجملة عند كبار أتباع الإمام الشافعي، فهو دليل شرعي معتبر، وقد أصلوا لحجيته من الكتاب والسنة. Using inductive, descriptive, analytical, and critical methodologies, this study aims to examine the position of the esteemed scholar and leading figure of this Ummah, Imam Muḥammad ibn Idrīs al-Shāfiʿī, and his prominent followers regarding the authoritative status (ḥujjiyyah) of ijmā‘ (consensus). It also seeks to clarify their perspectives on its theoretical foundations, its rank among the sources of Islamic law, and the methodological framework through which they approached it.The study is structured into an introduction and three main sections. The introduction provides a brief account of Imam al-Shāfiʿī and his leading followers. The first section explores the definition of ijmāʿ both linguistically and in technical usage. The second section addresses Imam al-Shāfiʿī’s affirmation of the authority of ijmāʿ, while the third section presents the views of his prominent followers on the same subject.Among the most significant findings of the research are the following: Linguistically, ijmāʿ refers to two meanings—determination (ʿazm) and agreement. However, the technical definition accepted as authoritative refers to: "the unanimous agreement of the qualified mujtahids of the Ummah of Muḥammad ﷺ after his death, in a particular era, on a specific matter." Numerous statements are attributed to Imam al-Shāfiʿī on ijmāʿ, some of which may initially appear contradictory. However, upon close examination, it becomes evident that no real contradiction exists. Imam al-Shāfiʿī classifies ijmāʿ into two types: definitive (qaṭʿī) and speculative (ẓannī). He treats definitive consensus as equivalent in status to mutawātir (mass-transmitted) reports, and speculative consensus as analogous to solitary (āḥād) reports. Both types, however, are binding proof in his view. Furthermore, Imam al-Shāfiʿī emphasizes the necessity of relying on a textual basis (i.e., from Qur’an or Sunnah) when establishing ijmāʿ. His leading followers also regard ijmāʿ as a valid and recognized source of Islamic legislation, and they have anchored its authority in both the Qur’an and the Sunnah. | ||||
