| Abstract | ||||
| يهدف هذا البحث إلى دراسة الأحاديث والآثار الواردة في ابتداء غير المسلمين بالسلام. حيث قام بجمع هذه الأحاديث والآثار، ودراستها من الناحية الحديثية، والفقهية. ثم ختم الباحث بحثه بدراسة الحديث الوارد في النهي عن ابتداء غير المسلمين بالسلام، من الناحية الحديثية والاستدلالية. وأشارت النتائج إلى أنه صحّ عن النبي r أنه ابتدأ السلام-وإن استخدم صيغة مختلفة- لاثنين من غير المسلمين، وهم: هرقل عظيم الروم، وحَبر تيماء. وصح ذلك أيضا عن عدد من الصحابة والتابعين. وتوصل البحث أيضا إلى أنه لا يصح الاستدلال بحديث سهيل بن أبي صالح في النهي عن ابتداء غير المسلمين بالسلام، للكلام في حال سهيل، واختلاف رواياته واضطرابها. وأنه على فرض صحة حديث سهيل، فإنه محمول على أنه خاص بالمحاربين كما جاء ذلك نصا في أحاديث أخرى، وأن سهيلا رواه بالمعنى فحمله على العموم. وأوصت الدراسة بضرورة الربط بين النصوص النبوية وبين فهم الصحابة والتابعين لمعرفة المعنى المراد. وأنه لا بد من الوقوف على كل روايات الحديث وشواهده لمعرفة العام والخاص، والتأكد من أن الراوي رواه كما سمعه، لا كما فهمه. This research aims to study the hadiths and athar (narrations) concerning the permissibility of initiating greetings to non-Muslims. The researcher collected these hadiths and athar (narrations) and studied them from a hadith and jurisprudential perspective. The researcher then concluded his research by examining the hadith prohibiting initiating greetings to non-Muslims from a hadith and deductive perspective. The results indicated that it was authentically reported that the Prophet, may God bless him and grant him peace, initiated the greeting—albeit using a different form—with two non-Muslims: Heraclius, the Roman emperor, and the scholar of Tayma. This was also authenticated by a number of the Companions and Followers. The research also concluded that the hadith of Suhayl ibn Abi Saleh prohibiting initiating greetings to non-Muslims cannot be used as evidence, due to the discussion surrounding Suhayl's situation and the differences and confusion in his narrations. Even if the hadith of Suhayl is authentic, it can be interpreted as specifically referring to combatants, as stated explicitly in other hadiths. Suhayl narrated it in its meaning, thus interpreting it as general. The study recommended the necessity of linking the prophetic texts with the understanding of the Companions and their followers to discern the intended meaning. It is also essential to examine all hadith narrations and their supporting evidence to understand the general and specific aspects of the hadith, and to ensure that the narrator narrated it as he heard it, not as he understood it. | ||||
