| Abstract | ||||
| والحروب، حيث يمثل الجانب الأخلاقي في العلاقات المتبادلة بين أشخاص القانون الدولي، ويمثل في ذات الآن امتداداً لقانون الحرب وأعراف النزاعات المسلحة المنبثقة من الشرائع الدينية والشعور المشترك بالإنسانية وتحظى إتفاقيات جنيف الأربع بثقل كبير في مجال تنظيم الأعمال العدائية والحفاظ على الاعتبارات الإنسانية أثناء النزاعات المسلحة الدولية وغير الدولية وحالات الإحتلال الحربي. يمثل تطبيق اتفاقيات جنيف الأربع على الساحة الفلسطينية مطلباً إنسانياً ذلك أن الاحتلال الإسرائيلي المتد منذ أكثر من سبعة عقود عمل تفويض الأحكام المعيارية في سياق القانون الدولي الإنساني والتنكر لها لذا يصبح البحث في مدى إمكانية تطبيق هذة الاتفاقيات على الساحة الفلسطينية مسألة أساسية متعددة الأوجه، فمن ناحية يجب دراسة فرص تطبيق هذة الاتفاقيات على الساحة الفلسطينية من الناحية النظرية ومن ناحية أخرى يجب دراسة فرص تحقيق ذلك من الناحية الواقعية. abstract International humanitarian law (Geneva Law and Hague Law) seeks to humanize conflicts and wars, as it represents the moral aspect of the mutual relations between the subjects of international law, and at the same time represents an extension of the law of war and the customs of armed conflicts emanating from religious laws and the common sense of humanity. The four Geneva Conventions have great weight in the field of organizing hostilities and preserving humanitarian considerations during international and non-international armed conflicts and cases of military occupation. Applying the four Geneva Conventions in the Palestinian arena represents a humanitarian requirement, as the Israeli occupation that has lasted for more than seven decades has worked to delegate the normative provisions in the context of international humanitarian law and deny them. Therefore, research into the possibility of applying these conventions in the Palestinian arena becomes a fundamental multi-faceted issue. On the one hand, the opportunities for applying these conventions in the Palestinian arena must be studied from a theoretical perspective, and on the other hand, the opportunities for achieving this must be studied from a realistic perspective . | ||||
