Abstract | ||||
This research aimed to identify the nature of the criminal phenomenon and its impact on security in society and its development, as there is a deep connection between social security and the criminal phenomenon. The psychological element is the essence of the crime and not as some believe that the material origin is the basis of this phenomenon. The criminal phenomenon is a behavior that attacks a criminally protected interest that was previously determined by the legislator. It is issued from a free, conscious, and sinful will, as law has decided for it a criminal penalty that is paid in the name of society. Criminology studies the criminal phenomenon to understand its causes and components and differentiates between the internal and external motivating factors of crime through the surrounding environment and the circumstances of the crime. Scientific progress has a moral impact on society, which results in some crimes against the individual and society. Some have defined crime as human behavior that is contrary to prevailing moral values and principles in society. It is not so unless two basic conditions are met: that it is in violation of a specific legislative text prior to committing the behavior, and secondly that this behavior involves the squandering of one of the essential interests, the violation of which is considered a crime by the legislator, regardless of its seriousness (felony, misdemeanor or violation). Social security is a set of security elements that come together to provide reassurance and protection for members of society. | ||||
