| Abstract | ||||
| الملخـص: اعتمدت الباحثة على المنهج الاستقرائي، والاستدلالي، ثم ذكرت المسائل محل الإشكال، والرد عليها بأقوال العلماء، وهي: حكم خدمة المرأة لزوجها، وحكم إرضاع الزوجة لابنها بأُجرة من زوجها، وحكم علاج الرجل لزوجته، وحكم تجهيز الزوجة المتوفاة من مال الزوج، وذكرت لكل مسألة أدلتها، ورجحت بحسب ما رأيت بقوة الدليل أو باعتبار أن العرف هو الحاكم وأنه يتغير بتغير حياة الناس وما اعتادوه في أحوالهم، ومن توصيات البحث: إعمال مقاصد الإسلام، والنظر إلى كلياته وأنه أتى لحفظ الدين والنفس والمال والنسل. كذلك النظر إلى أدلة الإسلام العامة كقوله تعالى: {وَلَا تَنسَوُا الْفَضْلَ بَيْنَكُمْ} [البقرة: 237] ففي ذلك صرف للشر والفرقة والاختلاف، ومراعاةً لاستقرار الأسرة وبعدِها عن النزاعات والظلم. Abstract: The researcher employed the inductive and deductive methods in this study. The research is structured around several issues، beginning with an introduction to Islam as the religion chosen by Allah (SWT)، which concluded the series of divine religions. It then addresses controversial topics، providing responses based on scholarly opinions. The issues discussed include: the wife’s service to her husband، the wife breastfeeding her child for a fee from her husband، and the husband treating his wife medically. For each issue، evidence is provided، and conclusions are drawn based on the strength of the evidence or the principle that social customs may govern in the absence of clear legal rulings. The researcher has selected these topics due to their prominence on social media platforms. One of the main findings of the research is that it is incorrect to direct blame or create tension between fatwas and the spirit of the times for the Shari'ah; rather، it is a matter of ijtihad by scholars، and each era’s issues must be applied to its context، considering societal norms unless there is explicit evidence from Shari'ah. The research concludes with several recommendations، including the importance of implementing the objectives (maqasid) of Islam، considering its general principles، such as the preservation of religion، life، wealth، and lineage. The study also emphasizes the consideration of general Islamic evidences، such as the verse from Surah Al-Baqarah: "And do not forget graciousness between you" [Al-Baqarah 237]، which prevents discord and division and promotes family stability and avoidance of disputes and injustice. | ||||
