| Abstract | ||||
| يعد هذا البحث دراسة وتحقيقاً لكتاب في علم الفرائض متعلقاً بباب المناسخات منه، حيث قصد المصنف إلى وضع طريقة يمكن من خلالها حل مسائل المناسخات بجامعة واحدة لما رأى كثرة طرق حل المناسخات وما فيها من مشقة وعدم إطراد، فذكر طريقة لحل المناسخات إذا كان فيها أكثر من ميتين بجامعة واحدة، وأورد على ذلك خمسة أمثلة لأحوال مختلفة تتضح من خلالها طريقة العمل، وهذا مقصوده من تأليف كتابه، ثم ذكر المصنف تنبيهات أربع، وهي: العمل فيما إذا لم يكن بين التركة والجامعة موافقة بل كان بينهما مباينة، والعمل فيما إذا وجد في التركة كسر أو كسور، وطريقة اختصار ما يخص الوارث من كسور التركة، وطريقة معرفة ما يخص الوارث من كل ميت على حدة، وأنواع الاختصار في المناسخات، وبيان الأنسب في الجواب عن تفصيل أنصباء الورثة، ثم ختم المصنف كتابه بفوائد، وهي: طرق قسمة التركات ومعرفة نصيب الوارث من التركة، وبيان مقدار مخرج الحبة والدانق والأرزة، فيما تكون فيه قسمة التركة بالقراريط، وطريقة معرفة التركة من خلال معرفة مقدار ما يرثه بعض الورثة. This research is a study and verification of a book on inheritance law, dealing with the chapter on abrogation. The author sought to establish a method by which to resolve abrogation issues within a single university, given the numerous methods for resolving abrogation issues, their difficulty, and the lack of consistency involved. He mentioned a method for resolving abrogation issues when there are more than two deceased persons within a single university. He provided five examples of different situations that illustrate the method of action. This is his purpose in writing his book. The author then mentioned four caveats: action when there is no agreement between the estate and the university, but rather a discrepancy between them; action when there is a fraction or fractions in the estate; and a method for abbreviating what pertains to the heir from Fractions of the estate, how to determine the heir's share of each deceased person individually, types of abbreviations in abbreviations, and an explanation of the most appropriate answer to the details of the heirs' shares. The author then concludes his book with useful information, including: methods for dividing estates and determining the heir's share of the estate, an explanation of the amount of the grain, daniq, and rice, when the estate is divided in qirats, and a method for determining the estate by determining the amount inherited by some heirs. | ||||
