Abstract | ||||
الحمد لله الرحيم المنّان، عظيم الهبات والإحسان، خلق الإنسان وعلَّمَهُ البيان، ويسَّر له طريق العلم وسهّلَهُ وأبان، ثم أتم فضله بأن جعل هذا الدرب طريقًا للجنان. أما بعد: لما كانت الشريعة الإسلامية خاتمة الأديان، كان أبرز محاسنها صلاحيتها لكل زمان ومكان، فمهما تطورت الأزمنة واستجدت المسائل نجد في شريعتنا ما يعالج قضايانا المعاصرة، فيتلقاها الفقهاء والباحثين بالدراسة والتنزيل على أصول الشريعة ومقاصدها، ومع تسارع الزمان أصبح التطور مطلوبا في شتى المجالات ومن ذلك باب الوصايا. ولما كانت الوصية قبل وفاة المسلم غاية في الأهمية عند إثباتها لحفظ حقوق الناس، تسارعت الدول لمواكبة تلك التطورات في هذا الباب؛ إسهامًا منها في تقديم الخدمات لشعوبها ومواطنيها. ولقد كان للمملكة العربية السعودية جهودا عظيمة في مواكبة هذا التطور وإدخال التقنيات المستجدة في الجهات العدلية والقضائية، واستخدام الوسائل المتطورة في إثبات هذه الوصايا تذليلاً لسرعة البت فيها. فظهر لي أهمية إبراز هذه الوسائل المستجدة المتطورة في إثبات الوصية دراسة فقهية وموازنتها بالمعمول به في المملكة العربية السعودية. والذي عنونت له بـ : "طرق إثبات الوصية بالوسائل المستجدة والمتطورة - دراسة فقهية موازنة بالنظام السعودي المعمول به في المملكة العربية السعودية- " ويهدف البحث إلي العناية بما استجد من وسائل متطورة في ثبوت الوصايا، وأهميتها في حفظ الحقوق. ويبرز البحث إظهار موقف النظام السعودي بالمملكة العربية السعودية من هذه الوسائل، وتطوير كل ما يحقق إثبات الوصية بدقة وفق ضوابط الشريعة الإسلامية. Abstract: Praise be to Allah, the Compassionate, the Bountiful, who bestows great gifts and favors. He created man and taught him to articulate, making the path of knowledge easy and clear. He then perfected His grace by making this path a road to paradise. To proceed: Since Islamic law is the final divine religion, its most prominent virtue is its suitability for every time and place. No matter how times evolve and new issues arise, we find in our Shari'a what addresses our contemporary concerns. Scholars and researchers study these matters and apply them according to the principles and objectives of Shari'a. With the rapid pace of time, development has become necessary in all fields, including the chapter on wills. Since a will made before a Muslim's death is extremely important for preserving people's rights, countries have rushed to keep pace with these developments in this area, contributing to the provision of services for their people and citizens. The Kingdom of Saudi Arabia has made great efforts to keep up with this development, introducing new technologies into its judicial and legal departments and using advanced methods to prove these wills to accelerate their resolution. This has highlighted the importance of showcasing these new and advanced methods for proving wills from a jurisprudential perspective and comparing them with the current practices in the Kingdom of Saudi Arabia. I have titled this research: "Methods of Proving Wills with New and Advanced Means - A Jurisprudential Study Compared with the Saudi System in the Kingdom of Saudi Arabia." The research aims to focus on the new, advanced methods for proving wills and their importance in preserving rights. It will also highlight the position of the Saudi system in the Kingdom of Saudi Arabia on these methods and the development of everything that ensures accurate proof of a will according to the regulations of Islamic Shari'a. | ||||
