| Abstract | ||||
| ملخص البحث: يتناول هذا البحث دراسة نقدية لكتاب "الفروع" لابن مفلح من خلال تعقبات المرداوي عليه ، ويبرز البحث أهمية التعقبات في بيان قوة التحقيق الفقهي وتمايز الروايات في المذهب الحنبلي، كما تسلط الضوء على أثر التعقبات في توضيح الأقوال وتوجيهها نحو الصواب وفق المعتمد في المذهب ، فالبحث يتناول تعقبات المرداوي على ابن مفلح في كتابه "الفروع"، كما وردت في كتاب "الإنصاف"، وتُظهر هذه التعقبات دقة المرداوي في تصحيح الأقوال وتحقيق الروايات وفق المعتمد في المذهب الحنبلي ، ولقد استخدمت الباحثة المنهج التحليلي من خلال التحقيق والمقارنة بين النصوص، وترجيح القول الصحيح بالدليل، وتوصل البحث إلي عدة نتائج من أهمها: أن تعقبات المرداوي على ابن مفلح في كتاب "الفروع" ساهمت في إبراز آراء جديدة أو تعزيز الأقوال الراجحة في المذهب، مما ساعد في تطوير الفقه الحنبلي وتوسيعه, وأن هذه التعقبات أظهرت دقة المرداوي في التحقيق الفقهي واعتماده على النصوص الشرعية وأقوال الإمام أحمد بن حنبل، مع اهتمامه بتمييز الروايات الأصح من غيرها ،وأنه يُعنى أيضا ببيان الروايات الصحيحة عن الإمام أحمد بن حنبل، وتقديم الأشهر منها، كما أنه ينتقد أحيانًا منهجية ابن مفلح في اختيار بعض الآراء، أو ينبه إلى أمور خفيت على ابن مفلح أثناء كتابته، كما يوصي البحث الباحثين غيره بتوصيات منها ، إجراء دراسة مقارنة بين تعقبات المرداوي في "الإنصاف" وآراء ابن مفلح في "الفروع"، مع توضيح أثر هذه التعقبات على تطور المذهب الحنبلي. ، وتحليل منهج المرداوي في نقده للمسائل الفقهية، مع دراسة الأسس التي اعتمد عليها في الترجيح بين الروايات، وتحقيق كتابي "الفروع" و"الإنصاف" بأسلوب علمي حديث، مع إضافة تعليقات توضيحية للتعقبات Abstract: This research presents a critical study of Ibn Muflih's book "Al-Furu'" through the critiques of Al-Mardawi. It highlights the importance of these critiques in demonstrating the strength of jurisprudential investigation and distinguishing the various narrations within the Hanbali school. The study also emphasizes the impact of these critiques in clarifying and directing opinions towards correctness according to the authoritative positions within the school. The research examines Al-Mardawi's critiques of Ibn Muflih in his book "Al-Furu'," as presented in "Al-Insaf." These critiques showcase Al-Mardawi's precision in verifying opinions and authenticating narrations based on the established positions in the Hanbali school. The researcher employed the analytical method through verification and comparison between texts, favoring the correct opinion with evidence. The study underscores the significance of scholarly critique in enhancing jurisprudential accuracy and clarifying the authoritative positions within the school. Among the key findings are : Al-Mardawi's critiques of Ibn Muflih in "Al-Furu'" contributed to presenting new perspectives or reinforcing the prevailing opinions within the school, thereby aiding in the development and expansion of Hanbali jurisprudence . These critiques demonstrated Al-Mardawi's meticulousness in jurisprudential verification, his reliance on religious texts and the sayings of Imam Ahmad ibn Hanbal, and his attention to distinguishing the most authentic narrations. He also focused on clarifying the authentic narrations from Imam Ahmad ibn Hanbal, prioritizing the most renowned among them. Additionally, he occasionally critiqued Ibn Muflih's methodology in selecting certain opinions or pointed out aspects that Ibn Muflih may have overlooked during his writing . The research recommends that scholars conduct comparative studies between Al-Mardawi's critiques in "Al-Insaf" and Ibn Muflih's views in "Al-Furu'," elucidating the impact of these critiques on the evolution of the Hanbali school. It also suggests analyzing Al-Mardawi's methodology in critiquing jurisprudential issues, studying the foundations he relied upon in preferring certain narrations, and producing scholarly editions of "Al-Furu'" and "Al-Insaf" with modern academic approaches, including explanatory comments on the critiques. | ||||
