| Abstract | ||||
| ملخص البحث: تهدف هذه الدراسة إلى بيان أثر الذكاء الاصطناعي في تطبيق قاعدة الاحتياط في الشريعة الإسلامية، من خلال تحليل مدى توافق التقنيات الحديثة مع الضوابط الأصولية والفقهية. وتتناول الدراسة مفهوم الاحتياط، وأدلته الشرعية، وضوابطه، ودوره في ضبط الفتوى والحكم الشرعي عند الشك أو غلبة الظن، إضافة إلى تعريف الذكاء الاصطناعي وتطبيقاته المعاصرة في المجالات الشرعية كالإفتاء والتحليل الفقهي. كما تُبرز الدراسة مدى قدرة أنظمة الذكاء الاصطناعي على مراعاة مقاصد الشريعة وضوابط الاحتياط، وتناقش مدى ميلها نحو التيسير أو التشدد، وقدرتها على تقدير مواطن الشك كالفقيه الأصولي. وتعالج الدراسة التحديات الشرعية والأخلاقية الناتجة عن الاعتماد على هذه التقنيات في الاستنباط. ويعتمد البحث على المنهج الاستقرائي التحليلي والمقارن، من خلال استقراء النصوص الشرعية وآراء العلماء وتحليل تطبيقات الذكاء الاصطناعي، ثم مقارنة مخرجاتها مع التوجهات الفقهية في ضوء قاعدة الاحتياط. ويهدف إلى تقديم رؤية علمية متوازنة توجّه استخدام التقنية الحديثة بما ينسجم مع مقاصد الشريعة دون الإخلال بثوابتها. Abstract: This study aims to explore the impact of artificial intelligence (AI) on the application of the Islamic legal principle of precaution (iḥtiyāṭ), by analyzing the compatibility of modern technologies with the fundamental jurisprudential and legal frameworks in Islamic law. The study addresses the concept of precaution, its evidential basis, conditions, and its role in guiding fatwas and legal rulings in cases of doubt or predominant conjecture. It also presents a definition of AI and its contemporary applications in Islamic fields such as fatwa issuance, legal analysis, and judicial solutions. The research highlights the extent to which AI systems can adhere to the objectives of Islamic law (maqāṣid al-sharīʿah) and the conditions of precaution, examining whether these systems tend toward leniency or strictness, and whether they can assess uncertainty as a jurist does. The study also discusses the ethical and legal challenges arising from reliance on AI in deriving rulings. The research adopts an inductive, analytical, and comparative methodology, by exploring Islamic texts and scholarly opinions, analyzing AI applications, and comparing their outcomes with Islamic jurisprudential trends in light of the principle of precaution. The study aims to provide a balanced perspective that integrates technological advancement with the core values of Islamic law. | ||||
