| Abstract | ||||
| ملخص البحث: فإن (دلالة العام في الأشخاص على العموم في الأحوال والازمنة والبقاع والمتعلقات) من القواعد التي لم تذكر تفصيلها وبيان الخلاف فيها في كتب الأصول، وإنما يشار إليها عند الكلام عن العام أو المطلق. وقد حاولت جاهدة جمع ما يتعلق بهذه المسألة من خلال التعريف بالعام والمطلق وبيان الفرق بينهما، وتحرير لمحل النزاع في القاعدة، وبيان أقوال الأصوليين فيها وأدلة في هذا البحث، مما يثري فهماُ لهذه القاعدة العظيمة. منهج البحث: سلكت في البحث المنهج الاستقرائي التحليلي من خلال تتبع المسألة والخلاف فيها، وتحرير محل النزاع من كتب الأصول. وخلصت الدراسة إلى مجموعة نتائج أهمها: أن عموم العام في جميع أفراده يدل بالالتزام لا بالمطابقة على عموم الأحوال، والأزمنة، والبقاع، والمتعلقات على القول الراجح. أن كثيراً من الاختلاف بين الأئمة في مسائل الفروع مبني على أسس علميه ومناهج استنباطية. وأوصت الدراسة : يراعى عند الكتابة في القواعد الأصولية المؤثرة في الخلاف الفقهي محاولة تحريرها وتهذيبها، وبيان المراد منها، وتدعيم تلك القواعد بصحيح النقل والأثر. إعادة عرض القاعدة الأصولية بما يسهل فهمها ويثريه ويبعده عن الغموض. التركيز على إثراء القاعدة الأصولية بالأمثلة والتطبيقات الفقهية في محاولة لربط الفروع الفقهية بأصولها وقواعدها المناسبة لها؛ مما يثري فهم تلك القواعد على ضوء النصوص الشرعية، وأقوال العلماء. Abstract: The indication of the general in individuals to the general in conditions, times, places and related matters is one of the rules that were not mentioned in detail and the disagreement about it was not explained in the books of principles, but rather it is referred to when talking about the general or the absolute I have tried hard to collect what is related to this issue by defining the general and the absolute and explaining the difference between them, clarifying the place of dispute in the rule, and explaining the statements of the scholars of principles about it and evidence in this research, which enriches the understanding of this great rule. Research Methodology: I followed the analytical inductive method in the research by tracking the issue and the disagreement therein, and identifying the subject of the dispute from the books of principles. The study concluded with a set of results, the most important of which are: The generality of the general in all its individuals indicates, through commitment rather than conformity, the generality of conditions, times, places, and related matters, according to the preponderant opinion. Much of the disagreement among imams on branch issues is based on scientific foundations and deductive methods. The study recommended: When writing about the fundamental principles affecting jurisprudential disputes, one should endeavor to edit and refine them, clarify their intended meaning, and support these principles with authentic transmission and evidence. Represent the fundamental principle in a way that facilitates understanding, enriches it, and removes ambiguity. Focusing on enriching the fundamental principles with examples and jurisprudential applications in an attempt to link the branches of jurisprudence to their appropriate origins and rules, thus enriching the understanding of those rules in light of the legal texts and the statements of scholars. | ||||
